Part 1 Introduction
1.1Name of Determination
This Determination is the Veterans' Entitlements Treatment (Centre for Military and Veterans’ Health) Determination 6/2003.
1.2Commencement
This Determination commences on the date it is made.
1.3Definitions
In this Determination:
Act means the Veterans’ Entitlements Act 1986.
Board of Management means the group of representatives from the Departments of Defence and Veterans’ Affairs and from the University of Queensland responsible for the management of the Centre for Military and Veterans’ Health.
Centre for Military and Veterans’ Health means the entity in the University of Queensland, Herston Campus, operated by the Board of Management.
CMVH treatment means action taken with a view to maintaining eligible veterans in physical or mental health and includes:
(a) training members in the health care disciplines that could benefit the health of eligible veterans;
(b) conducting research into injuries or diseases suffered by members or into the state of health generally of members with the resulting knowledge being applied to the benefit of the health of eligible veterans;
(c) improving communication on health care matters between members who are staff-managers and eligible veterans; and
(d) conducting health-care policy research with the outcomes of that research being applied to the benefit of the health of eligible veterans.
Note: under subsection 80(1) of the Acttreatment can be action taken with a view to maintaining a person in physical or mental health.
Defence Force has the same meaning it has in subsection 5C(1) of the Act.
disease has the same meaning it has in subsection 5D(1) of the Act.
eligible veteran means a veteran who is eligible for CMVH treatment by virtue of this Determination.
injury has the same meaning it has in subsection 5D(1) of the Act.
member means a person who is a member of the Defence Force.
Repatriation Commission means the body described in section 179 of the Act.
specified treatment means treatment described in Part 3.
veteran means a person who is a veteran under Part V of the Act.
Note: "veteran" under Part V of the Act includes a member of the Forces and a member of a Peacekeeping Force.
1.4 Purpose
The purpose of this Determination is to enable the Repatriation Commission to accept financial liability for part of the costs associated with CMVH treatment provided to an eligible veteran. The aim of CMVH treatment is to maintain eligible veterans in physical or mental health. CMVH treatment may be provided under the auspices of the Centre for Military and Veterans’ Health.
Part 2 Eligibility for Treatment
2.1Specified Class of Veterans Eligible for Specified Treatment
2.2 A veteran who is a member is eligible to be provided with specified treatment under Part V of the Act.
Part 3Specified Treatment
3.1Kind of treatment veteran within specified class is eligible to receive
3.2For the purposes of paragraph 88A(1)(a) of the Actand this Determination "treatment of a specified kind" is:

Note:"treatment" under subsection 80(1) of the Act is very broad and
includes action taken with a view to maintaining a person in physical or mental health.
