The Repatriation Commission, under subsection 52ZZZWH(4) of the Veterans’ Entitlements Act 1986 (the Act) makes the following Guideline.

1. Name

   This Guideline is the Veterans’ Entitlements (Special Disability

   Trust) Amendment Guideline 2016.

2. Commencement

   This Guideline commences on the day after it is registered. 

1. Amendment of the Veterans’ Entitlements (Special Disability Trust) Guidelines 2011

The Veterans’ Entitlements (Special Disability Trust) Guidelines 2011 are amended as set out in the items in the Schedule to this instrument.

Schedule 

Amendments to the Veterans’ Entitlements (Special Disability Trust) Guidelines 2011

1. Part 3, subparagraph 3.2(3)(b)(iii)

omit

trust.

substitute

trust; or

1. Part 3, subparagraph 3.2(3)(b)(iii)

after the subparagraph, insert

(c)the transferor:

(i)transferred the asset to a trust intended to be a special disability trust after the end of the 3 year period mentioned in paragraph 52ZZZWE(1)(b) of the Act; and

(ii)can show there was an intention to transfer the asset to the trust before the end of that 3 year period.
