1  Name

This is the VET Student Loans (Courses and Loan Caps) Determination 2016.

3  Authority

This instrument is made under the VET Student Loans Act 2016.

4  Definitions

In this instrument:

indexation factor has the same meaning as in the Higher Education Support Act 2003.

5  Approved courses and maximum loan amounts

(1) For paragraph 14(2)(a) of the VET Student Loans Act 2016, the courses for which VET student loans may be approved are:

(a)   the VET courses with the course codes specified in Schedules 1, 2 and 3 to this instrument (each a ‘specified course’);

(b)   any course identified in the National Register as a later version of, or superseding course to, a specified course (‘later version of a specified course’).

Note 1: Course codes for VET courses are set out in the National Register referred to in section 216 of the National Vocational Education and Training Regulator Act 2011.  In 2016, the National Register could be found at  2:      Course mapping information about current and earlier versions of VET courses is included in the National Register.

(2)  However, a course with a course code specified in Schedule 3 to this instrument or any later version of a specified course is only a course for which VET student loans may be approved if it is provided by the approved course provider specified for the course in Schedule 3.

(3)  The maximum loan amount for a course is as follows:

(a)  for a course with a course code specified in Part 1 of Schedule 1 or any later version of a specified course—$5 000;

(b)  for a course with a course code specified in Part 2 of Schedule 1 or any later version of a specified course—$10 000;

(c)  for a course with a course code specified in Part 3 of Schedule 1 or any later version of a specified course—$15 000;

(d)  for a course with a course code specified in Schedule 2 or 3 or any later version of a specified course—the amount specified in that Schedule for the course.

Note 1:       These amounts are indexed every year under section 6.

Note 2: Paragraphs 8(b) and (c) of the VET Student Loans Act 2016 place other limits on the amount of a VET student loan.

6  Indexing maximum loan amounts

(1)  The maximum loan amount for a course is indexed on 1 January 2018, and each subsequent 1 January, by multiplying it by the indexation factor for the relevant year.

(2)  However, an amount is not indexed if its indexation factor is 1 or less.

(3)  If an amount worked out under subsection (1) is an amount made up of dollars and cents, round the amount down to the nearest dollar.

Note:      New courses specified in Schedule 1, 2 or 3 are taken to be indexed from 1 January 2018.

The amendment history in endnote 4 provides information about amendments at the provision (generally section or equivalent) level. It also includes information about any provision of the compiled law that has been repealed in accordance with a provision of the law.

Misdescribed amendments

A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.
