AN ACT to amend the Vermin Boards Act, 1909, to Validate the Constitution of certain Districts, and the Rates made by the Boards thereof, and for other relative purposes.

liament assembled, and by the authority of the same, as follows:-

| (1.) The Districts mentioned in the Schedule to this Act shall be deemed to have been lawfully constituted under the principal | Validation of tho |

of the first members of each Board, were from time to time declared by notice in the Government Gazette to have been elected as mem- bers of such Boards respectively, shall be deemed to have been duly elected; and any order heretofore made by the Governor whereby the Minister for Lands and Agriculture was authorised
to exercise the powers, authorities, functions, and duties of any
such Board on the suspension or abolition of the Board shall be deemed to have been duly and lawfully made, and section thirty- five of the principal Act shall have effect, and all property, powers, authorities, immunities, rights, privileges, functions, obligations, and duties vested in or imposed on the Board shall, by force of the principal Act, he transferred to and vested in, and from the publication in the Government Gazeile of such order shall be deemed to have been transferred to and to have vested in, the said Minister accordingly.
Provided that no proceedings shall be taken for the recovery of rates heretofore struck if, and so long as, the amount thereof is paid by equal annual instalments extending over ten years from the commencement of this Act; the first of such instalments to be payable at the expiration of one month from the commencement Of this Act, and every subsequent instalment to become payable at the expiration of ea& succeeding period of twelve calendar months.
| Validation of | (2.) All rates heretofore struck, made, levied, or purporting to have been struck, :made, or levied by the Board of any of the said Districts shall be deemed to have been lawfully struck, made, and levied, and shall be recoverable, and payment thereof may be enforced, as if the provisions of the principal Act and the regula- tions made thereunder had been in all respects complied with, notwithstanding any failure to give any notice required to be given by the principal Act, and notwithstanding any other non-compliance with any such provisions as aforesaid; and such rates, and all rates hereafter duly made and levied, may he recovered under the pro- visions of the principal Act by distress, or in a summary way by proceedings against the owner of the holding for the time being before two or more justices of the peace. |

Section six of the principal Act is amended by omitting para-
graph (a) of subsection (1), and inserting in place thereof a
paragraph as follows:—

" (a.) Constitute any defined portion of the State a Vermin District -for the purposes of this Act, and specify the boun- daries of, and assign a name to such District."
Amendment of
Sections forty-seven and forty-nine of the principal Act are hereby amended by striking out in the said sections the words " two shillings" and by inserting in lieu thereof the words "one shilling."
