1. The applicant seeks special leave to appeal from a decision of the Court of Appeal of the Supreme Court of New South Wales (Ward P, Macfarlan and Mitchelmore JJA), allowing an appeal from the Supreme Court of New South Wales (Williams J).

2. The proposed appeal would involve the application of established principles to the construction of a particular agreement and would not raise any question of principle. Special leave should be refused.

3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
