Vehicle and Traffic (Vehicle Standards) Amendment (Heavy Vehicle) Regulations 2014

1Short titleThese regulations may be cited as the Vehicle and Traffic (Vehicle Standards) Amendment (Heavy Vehicle) Regulations 2014 . 2CommencementThese regulations take effect on the day on which section 4 of the Heavy Vehicle National Law (Tasmania) Act 2013 commences. 3Principal RegulationsIn these regulations, the Vehicle and Traffic (Vehicle Standards) Regulations 2001 are referred to as the Principal Regulations. 4Regulation 6 amended (Diagrams) Regulation 6(2) of the Principal Regulations is amended by omitting ", except the essential diagram in regulation 152 ,". 5Regulation 19 amended (Compliance with second edition ADRs) Regulation 19 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "vehicle" twice occurring and substituting "light vehicle"; (b) by omitting from subregulation (2) "vehicle" first occurring and substituting "light vehicle"; (c) by omitting from subregulation (2) "vehicle" second occurring and substituting "light vehicle"; (d) by omitting from subregulation (3) "vehicle" first occurring and substituting "light vehicle"; (e) by omitting from subregulation (3) "vehicle" second occurring and substituting "light vehicle"; (f) by omitting from subregulation (4) "vehicle" twice occurring and substituting "light vehicle". 6Regulation 20 amended (Compliance with third edition ADRs) Regulation 20 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "vehicle" twice occurring and substituting "light vehicle"; (b) by omitting from subregulation (2) "vehicle" first occurring and substituting "light vehicle"; (c) by omitting from subregulation (2) "vehicle" second occurring and substituting "light vehicle"; (d) by omitting from subregulation (3) "vehicle" first occurring and substituting "light vehicle"; (e) by omitting from subregulation (3) "vehicle" second occurring and substituting "light vehicle"; (f) by omitting from subregulation (4) "vehicle" twice occurring and substituting "light vehicle". 7Regulation 21 amended (Exception to compliance with ADRs: light vehicles that are not road vehicles) Regulation 21 of the Principal Regulations is amended by omitting "vehicle" first occurring and substituting "light vehicle". 8Regulation 22 amended (Exception to compliance with ADRs: Motor Vehicle Standards Act) Regulation 22 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "vehicle" first occurring and substituting "light vehicle"; (b) by omitting from subregulation (2) "vehicle" first occurring and substituting "light vehicle"; (c) by omitting from subregulation (3) "vehicle" first occurring and substituting "light vehicle". 9Regulation 23 amended (Partial exception to compliance with ADRs: personally imported vehicles) Regulation 23(1) of the Principal Regulations is amended by omitting "vehicle" second occurring from the definition of personally imported vehicle and substituting "light vehicle". 10Regulation 27 amended (Steering) Regulation 27 of the Principal Regulations is amended as follows: (a) by omitting subregulations (1) and (2) and substituting the following subregulation: (1) A light motor vehicle must have a right-hand drive if it is less than 30 years old. (b) by omitting from subregulation (3) "motor vehicle" and substituting "light motor vehicle"; (c) by omitting from subregulation (4) "motor vehicle" and substituting "light motor vehicle"; (d) by omitting from subregulation (5) "vehicle" and substituting "light motor vehicle"; (e) by omitting from subregulation (6) "vehicle" and substituting "light motor vehicle". 11Regulation 28 amended (Turning ability) Regulation 28(1) of the Principal Regulations is amended by omitting "motor vehicle" and substituting "light motor vehicle". 12Regulation 29 amended (Ability to travel backwards and forwards) Regulation 29 of the Principal Regulations is amended by omitting "motor vehicle" and substituting "light motor vehicle". 13Regulation 30 amended (Protrusions) Regulation 30 of the Principal Regulations is amended by omitting subregulation (1) and substituting the following subregulations: (1) This regulation applies to – (a) a light vehicle; and (b) a heavy vehicle, if the heavy vehicle is not required to comply with a third edition ADR under the Heavy Vehicle (Vehicle Standards) National Regulation as applied in this jurisdiction by section 5 of the Heavy Vehicle National Law (Tasmania) Act 2013 . (1A) A vehicle must be designed, built and maintained in a way that minimises the likelihood of injury to a person making contact with the vehicle. 14Regulation 31 amended (Driver's view and vehicle controls) Regulation 31 of the Principal Regulations is amended by omitting "motor vehicle" and substituting "light motor vehicle". 15Regulation 32 substituted Regulation 32 of the Principal Regulations is rescinded and the following regulation is substituted: 32Seating and seatbelts A seat for a driver or passenger in a light motor vehicle must be securely attached to the vehicle. 16Regulation 33 amended (Mudguards) Regulation 33 of the Principal Regulations is amended as follows: (a) by omitting subregulation (1) and substituting the following subregulation: (1) A light vehicle must have firmly fitted a mudguard for each wheel or for adjacent wheels. (b) by omitting from subregulation (2) " subregulation (1)(a) " and substituting " subregulation (1) "; (c) by omitting subregulation (3) ; (d) by omitting from subregulation (4)(b) "vehicle" and substituting "light vehicle"; (e) by omitting from subregulation (5) "vehicle" first occurring and substituting "light vehicle". 17Regulation 35 amended (Horns, alarms, &c.) Regulation 35 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "motor vehicle" and substituting "light motor vehicle"; (b) by omitting from subregulation (2) "motor vehicle" and substituting "light motor vehicle"; (c) by omitting from subregulation (4) "motor vehicle" and substituting "light motor vehicle". 18Regulation 36 amended (Rear vision mirrors) Regulation 36 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "motor vehicle" and substituting "light motor vehicle"; (b) by omitting from subregulation (3)(a) "motor vehicle" and substituting "light motor vehicle"; (c) by omitting from subregulation (3)(c) "motor vehicle" and substituting "light motor vehicle"; (d) by omitting from subregulation (3)(d) "bus" and substituting "light bus"; (j) by omitting from subregulation (7) "bus" first occurring and substituting "light bus". 19Regulation 37 amended (Rear vision mirrors: surfaces) Regulation 37 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "motor vehicle" and substituting "light motor vehicle"; (b) by omitting from subregulation (2) "motor vehicle" first occurring and substituting "light motor vehicle". 20Regulation 38 amended (Additional rear vision mirrors) Regulation 38 of the Principal Regulations is amended by omitting "motor vehicle" and substituting "light motor vehicle". 21Regulation 39 amended (Automatic transmission) Regulation 39 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "motor vehicle" and substituting "light motor vehicle"; (b) by omitting from subregulation (2) "motor vehicle" and substituting "light motor vehicle"; (c) by omitting from subregulation (3) "motor vehicle" and substituting "light motor vehicle". 22Regulation 40 amended (Diesel engines) Regulation 40 of the Principal Regulations is amended as follows: (a) by omitting "motor vehicle" and substituting "light motor vehicle"; (b) by omitting "compression ignition engine, commonly known as a diesel engine," and substituting "diesel engine". 23Regulation 41 amended (Bonnet-securing devices) Regulation 41(1) of the Principal Regulations is amended by omitting "motor vehicle" and substituting "light motor vehicle". 24Regulation 42 amended (Electrical wiring, components, connections and installations) Regulation 42 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "vehicle" first occurring and substituting "light vehicle"; (b) by omitting from subregulation (1A) "vehicle" and substituting "light vehicle"; (c) by omitting from subregulation (2) "motor vehicles" and substituting "light motor vehicles"; (d) by omitting from subregulation (2) "trailers" and substituting "light trailers"; (e) by omitting from subregulation (3) "trailer" first occurring and substituting "light trailer"; (f) by omitting from subregulation (5) "bus" first occurring and substituting "light bus". 25Regulation 43 amended (Television receivers and visual display units) Regulation 43 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "vehicle" and substituting "light vehicle"; (b) by omitting from subregulation (2)(a) "vehicle" and substituting "light vehicle"; (c) by omitting from subregulation (3) "vehicle" first occurring and substituting "light vehicle". 26Regulation 43A amended (Requirement for windscreen to be fitted) Regulation 43A of the Principal Regulations is amended by omitting "motor vehicle" and substituting "light motor vehicle". 27Regulation 44 amended (Windscreens and windows) Regulation 44 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "motor vehicle" and substituting "light motor vehicle"; (b) by omitting from subregulation (4) "bus" and substituting "light bus". 28Regulation 45 amended (Window tinting) Regulation 45 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "motor vehicle" first occurring and substituting "light motor vehicle"; (b) by omitting from subregulation (2) "motor vehicle" and substituting "light motor vehicle"; (c) by omitting from subregulation (4) "motor vehicle" and substituting "light motor vehicle"; (d) by omitting from subregulation (5) "motor vehicle" and substituting "light motor vehicle". 29Regulation 46 amended (Windscreen wipers and washers) Regulation 46 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "motor vehicle" first occurring and substituting "light motor vehicle"; (b) by omitting from subregulation (2) "motor vehicle" first occurring and substituting "light motor vehicle"; (c) by omitting subregulations (3) and (4) . 30Regulation 47 amended (Wheels and tyres: size and capacity) Regulation 47 of the Principal Regulations is amended by omitting "vehicle" and substituting "light vehicle". 31Regulation 48 amended (Pneumatic tyres generally) Regulation 48 of the Principal Regulations is amended by omitting "vehicle" and substituting "light vehicle". 32Regulation 49 amended (Pneumatic tyres: carcass construction) Regulation 49(1) of the Principal Regulations is amended by omitting "vehicle with a GVM not over 4.5 tonnes" and substituting "light vehicle". 33Regulation 50 substituted Regulation 50 of the Principal Regulations is rescinded and the following regulation is substituted: 50Pneumatic tyres: size and capacity The size and capacity of a pneumatic tyre to be fitted to a light vehicle must be decided using a cold inflation pressure that is not more than the pressure recommended by the tyre manufacturer. | Note The maximum permissible tyre inflation pressures are prescribed in the Vehicle and Traffic (Vehicle Operations) Regulations 2001 . |
34Regulation 51 amended (Tyres: defects) Regulation 51 of the Principal Regulations is amended by omitting "vehicle" first occurring and substituting "light vehicle". 35Regulation 52 rescinded Regulation 52 of the Principal Regulations is rescinded. 36Regulation 53 amended (Tyres: manufacturer's rating) Regulation 53 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "motor vehicle" and substituting "light motor vehicle"; (b) by omitting from subregulation (1)(b) "1972; and" and substituting "1972."; (c) by omitting paragraph (c) from subregulation (1) ; (d) by omitting from subregulation (3) "motor vehicle" first occurring and substituting "light motor vehicle"; (e) by omitting from subregulation (4) "vehicle" and substituting "light motor vehicle". 37Regulation 54 amended (Retreads) Regulation 54 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "vehicle" and substituting "light vehicle"; (b) by omitting from subregulation (2) "vehicle" and substituting "light vehicle". 38Regulation 55 amended (Tyre tread) Regulation 55 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "vehicle" and substituting "light vehicle"; (b) by omitting from subregulation (2) "vehicle" first occurring and substituting "light vehicle"; (c) by omitting paragraph (a) from subregulation (2) and substituting the following paragraph: (a) across the tyre width that normally comes into contact with the road; and (d) by omitting from subregulation (3) "vehicle" and substituting "light vehicle". 39Regulation 59 amended (Vehicle and engine identification numbers) Regulation 59 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (2) "motor vehicle" and substituting "light motor vehicle"; (b) by omitting from subregulation (3) "motor vehicle" and substituting "light motor vehicle"; (c) by omitting from subregulation (4) "vehicle" first occurring and substituting "light vehicle"; (d) by inserting in subregulation (5) "identification number" after "A vehicle"; (e) by inserting in subregulation (5) ", of a light vehicle," after "engine identification number". 40Regulation 60 amended (White or silver band on certain vehicles) Regulation 60 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "vehicle" and substituting "light vehicle"; (b) by omitting from subregulation (3) "vehicle" first occurring and substituting "light vehicle". 41Regulation 61 rescinded Regulation 61 of the Principal Regulations is rescinded. 42Regulation 62 amended (Axle configuration) Regulation 62 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1) "motor vehicle, except an articulated bus," and substituting "light motor vehicle"; (b) by omitting subregulation (3) and substituting the following subregulation: (3) If 2 or more tail lights are fitted to a light vehicle, at least 2 must be fitted as a pair.
