Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (Vehicle Standards Consequential) Regulations 2001

1Short titleThese regulations may be cited as the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (Vehicle Standards Consequential) Regulations 2001 . 2CommencementThese regulations take effect on the day on which the Vehicle and Traffic Amendment (Vehicle Standards) Act 2001 commences. 3Principal RegulationsIn these regulations, the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2000 are referred to as the Principal Regulations. 4Regulation 3 amended (Interpretation) Regulation 3(1) of the Principal Regulations is amended as follows: (a) by omitting the definition of dog trailer and substituting the following definition: dog trailer means a trailer, including a trailer consisting of a semi-trailer and converter dolly, with – (a) one axle group or a single axle at the front that is steered by connection to the towing vehicle by a drawbar; and (b) one axle group or a single axle at the rear; (b) by omitting the definition of identification plate . 5Regulation 46 amended (Compliance with relevant vehicle standards) Regulation 46 of the Principal Regulations is amended by omitting subregulation (4) . 6Regulation 87 substituted Regulation 87 of the Principal Regulations is rescinded and the following regulation is substituted: 87Modification of registered vehicle If a registered motor vehicle or trailer has been modified, a person must not use it, or permit its use, on a public street unless – (a) in any case – (i) the vehicle, as modified, complies with the relevant vehicle standards; or (ii) the modification is otherwise acceptable to the Registrar; and (b) in the case of a heavy vehicle, the modification complies with the National Code of Practice for Heavy Vehicle Modifications (1993) published by the Federal Office of Road Safety as Vehicle Standards Bulletin No.6.

Penalty:  Fine not exceeding 20 penalty units.

7Regulation 121 rescinded Regulation 121 of the Principal Regulations is rescinded. 8Schedule 2 amended (Demerit Points Offences) Schedule 2 to the Principal Regulations is amended as follows: (a) by inserting in the note after the item "TRRR Traffic (Road Rules) Regulations 1999" the following item:

(b) by omitting from the Index "Driving without seatbelt" and substituting "Driving without seatbelts"; (c) by omitting items 167 and 168 and substituting the following:

EXPLANATORY NOTE

(This note is not part of the regulation) These regulations –

(a) amend the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2000 consequent on the reforms effected by the Vehicle and Traffic Amendment (Vehicle Standards) Act 2001; and (b) provide that regulation 85 of those regulations, which relates to vehicle inspection programs for public passenger vehicles and hire and drive vehicles, will remain in force after 1 January 2002.
