Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (Vehicle Inspection Fees) Regulations 2007

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Vehicle and Traffic Act 1999 .20 December 2007

1Short titleThese regulations may be cited as the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (Vehicle Inspection Fees) Regulations 2007 . 2CommencementThese regulations take effect on 1 January 2008. 3Principal RegulationsIn these regulations, the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2000 are referred to as the Principal Regulations. 4Regulation 3 amended (Interpretation) Regulation 3(1) of the Principal Regulations is amended as follows: (a) by omitting "specified" twice occurring from the definition of applicable scheduled fee and substituting "prescribed"; (b) by omitting the definition of remote vehicle inspection . 5Regulation 46 amended (Compliance with relevant vehicle standards) Regulation 46 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (2) "a" first occurring and substituting "some other"; (b) by omitting subregulation (3) . 6Regulation 48 amended (Application for registration) Regulation 48 of the Principal Regulations is amended by omitting subregulation (4) . 7Regulation 71 amended (Clearance of vehicle defect notice) Regulation 71 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (1)(b) "authorised" and substituting "approved"; (b) by omitting subregulation (3) . 8Regulation 85 amended (Vehicle inspection program for public passenger vehicles and hire and drive vehicles) Regulation 85 of the Principal Regulations is amended by omitting subregulation (8) . 9Regulation 110 amended (Fees generally) Regulation 110(1)(d) of the Principal Regulations is amended by inserting "that is carried out by a police officer or an authorised officer" after " Schedule 1 ". 10Schedule 1 amended (Fees) Schedule 1 to the Principal Regulations is amended as follows: (a) by omitting item 32 and substituting the following item:

(a) a bus

(b) a heavy vehicle

(b) by omitting items 39 , 40 and 41 and substituting the following items:

Inspection fees for clearing a vehicle defect notice –

VT 58A DLVR 71(2)

(a) in the case of a complete roadworthiness inspection of –

(i) a bus

(ii) a heavy vehicle

(b) in any other case

Inspection fees in the case of a random inspection of –

(a) a bus

(b) a heavy vehicle

Note: This item extends to any inspection carried out under the Act or these regulations except the following:

(a) an inspection carried out in relation to an application for registration, or renewal of registration, of a vehicle;

(b) an inspection carried out in relation to the clearance of a vehicle defect notice;

(c) an inspection carried out under a vehicle inspection program.

Inspection fees in the case of an inspection under a vehicle inspection program of –

VT 58A DLVR 85(1)

(a) a large passenger vehicle that is registered as a public passenger vehicle or a hire and drive vehicle

(b) a small passenger vehicle that is registered as a public passenger vehicle
