Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (Inspection) Regulations 2004

1Short titleThese regulations may be cited as the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (Inspection) Regulations 2004 . 2CommencementThese regulations take effect on the day on which their making is notified in the Gazette. 3Principal RegulationsIn these regulations, the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2000 are referred to as the Principal Regulations. 4Regulation 85 amended (Vehicle inspection program for public passenger vehicles and hire and drive vehicles) Regulation 85 of the Principal Regulations is amended as follows: (a) by inserting the following subregulation after subregulation (3) : (3A)  The Registrar may extend the interval between inspections under subregulation (3) , for a vehicle or a class of vehicles, if the Registrar is satisfied that such extension would not compromise road safety. (b) by omitting subregulation (10) and substituting the following subregulation: (10)  Subject to subregulation (11) , a person must not – (a) use, or permit the use of, a vehicle on a public street for hire or reward if the vehicle has not been presented for an inspection that it is required to have under a vehicle inspection program; or (b) use, or permit the use of, a vehicle on a public street if the vehicle does not pass an inspection under a vehicle inspection program.

Penalty:  Fine not exceeding 20 penalty units.

EXPLANATORY NOTE

(This note is not part of the regulation) These regulations amend the

(a) allowing the Registrar to extend intervals between vehicle inspections for public passenger vehicles and hire and drive vehicles if satisfied that it would not compromise road safety; and (b) prohibiting the use of a vehicle on a public street for hire or reward if the vehicle has not been presented for an inspection that it is required to have under a vehicle inspection program.
