Vehicle and Traffic Amendment (Road Safety Levy) Act 2007

An Act to amend the Vehicle and Traffic Act 1999

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Vehicle and Traffic Amendment (Road Safety Levy) Act 2007 . 2CommencementThis Act commences on the day on which this Act receives the Royal Assent. 3Principal ActIn this Act, the Vehicle and Traffic Act 1999 is referred to as the Principal Act. 4Section 40AA insertedAfter section 40 of the Principal Act , the following section is inserted in Part 6: 40AARoad safety levy The regulations may – (a) provide for the imposition of a levy, in connection with the registration and renewal of registration of vehicles, for the purpose of improving road safety; and (b) fix the amount of the levy; and (c) provide for the payment of the levy; and (d) provide for concessions, waivers, rebates or exemptions related to the levy; and (e) deal with incidental and ancillary matters. 5Sections 59A and 59B insertedAfter section 59 of the Principal Act , the following sections are inserted in Part 8: 59ARoad safety levies to be deposited into Special Deposits and Trust Fund If the regulations provide for the imposition of a levy for the purposes of section 40AA , the levies paid in accordance with those regulations are to be paid into an account in the Special Deposits and Trust Fund. 59BApplication of road safety levies (1)  If the regulations provide for the imposition of a levy for the purposes of section 40AA , the levies paid in accordance with those regulations are to be applied only for the purposes of improving road safety, as determined by the Minister. (2)  For the purposes of subsection (1) , the Minister may consult with such persons and bodies as the Minister thinks fit.
