Vehicle and Traffic Amendment (Red Light Cameras) Act 2001

An Act to amend the Vehicle and Traffic Act 1999

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Vehicle and Traffic Amendment (Red Light Cameras) Act 2001 . 2CommencementThis Act commences on the day on which the Traffic Amendment (Red Light Cameras) Act 2001 commences. 3Principal ActIn this Act, the Vehicle and Traffic Act 1999 is referred to as the Principal Act. 4Section 3 amended (Interpretation) Section 3(1) of the Principal Act is amended as follows: (a) by inserting the following definition after the definition of public passenger vehicle : red light offence means an offence, under the Traffic Act 1925 , of a driver entering an intersection contrary to a red traffic light or red traffic arrow; (b) by omitting the definition of speeding offence and substituting the following definition: speeding offence means an offence, under the Traffic Act 1925 , of a driver exceeding the speed-limit applying to the driver for the length of road where the driver is driving; 5Section 21 amended (Award of demerit points on conviction) Section 21(4) of the Principal Act is amended as follows: (a) by inserting "red light offence or" after "for a"; (b) by omitting paragraph (a) and substituting the following paragraph: (a) the offence is – (i) in the case of a red light offence, one of 2 or more red light offences committed in succession by the convicted person; or (ii) in the case of a speeding offence, one of 2 or more speeding offences committed in succession by the convicted person; and 6Section 22 amended (Award of demerit points on traffic infringement notice) Section 22(3) of the Principal Act is amended as follows: (a) by inserting "red light offence or" after "to a"; (b) by omitting paragraph (a) and substituting the following paragraph: (a) the offence is – (i) in the case of a red light offence, one of 2 or more red light offences committed in succession by the same offender; or (ii) in the case of a speeding offence, one of 2 or more speeding offences committed in succession by the same offender; and
