Vehicle and Traffic Amendment (Public Vehicles Reform) Act 2000
An Act to amend the Vehicle and Traffic Act 1999

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:
1Short titleThis Act may be cited as the Vehicle and Traffic Amendment (Public Vehicles Reform) Act 2000 . 2CommencementThis Act commences on the day on which this Act receives the Royal Assent. 3Principal ActIn this Act, the Vehicle and Traffic Act 1999 is referred to as the Principal Act. 4Section 15 amended (Public passenger vehicles) Section 15(1)(b) of the Principal Act is amended by omitting "(or is exempted under the regulations from the requirement to hold such a certificate)". 5Section 16 amended (Compliance with conditions) Section 16 of the Principal Act is amended as follows: (a) by omitting subsection (2) ; (b) by omitting from subsection (3) "or an authority corresponding to an ancillary certificate issued under a corresponding law"; (c) by omitting from subsection (4) "or an authority corresponding to an ancillary certificate issued under a corresponding law". 6Section 33 amended (Hire and drive vehicles) Section 33 of the Principal Act is amended by omitting subsection (3) and substituting the following subsection: (3) This section does not apply to – (a) the letting of a vehicle under a hire-purchase agreement made in good faith for the purchase of that vehicle; or (b) a long-term hiring arrangement having as its purpose the provision of financial accommodation to a person who takes a vehicle on hire; or (c) the hiring out of a passenger vehicle that, under a law of another Australian jurisdiction, is authorised to be hired out for reward without a driver. 7Section 38 amended (Driver licensing scheme) Section 38(2) of the Principal Act is amended as follows: (a) by omitting from paragraph (h) ", an ancillary certificate or an authority corresponding to an ancillary certificate issued under a corresponding law" and substituting "or an ancillary certificate"; (b) by omitting from paragraph (k)(i) "or an ancillary certificate" third occurring; (c) by omitting from paragraph (l)(i) "or an ancillary certificate" second occurring; (d) by omitting from paragraph (m) "or an ancillary certificate" second occurring. 8Section 48 amended (Miscellaneous document production requirements) Section 48(5) of the Principal Act is amended by omitting ", an ancillary certificate or an authority corresponding to an ancillary certificate issued under a corresponding law" and substituting "or an ancillary certificate". 9Section 49 amended (Inspection of vehicles) Section 49(7) of the Principal Act is amended by omitting paragraph (b) from the definition of related Act and substituting: (b) the Taxi and Luxury Hire Car Industries Act 1995; or 10Section 64 amended (Offences of dishonesty) Section 64(3)(b) of the Principal Act is amended by omitting "or is exempt from the requirement to hold an ancillary certificate".
