s1 2 s3 Vegetation Management Amendment Regulation No. 179, 2004 (No. 2) 2004 1 Short title This regulation may be cited as the Vegetation Management Amendment Regulation (No. 2) 2004 . 2 Regulation amended This regulation amends the VegetationManagementRegulation 2000. 3 Amendment of s 5 (Regions and ballots—Act, s 22G) (1) Section 5(1)— omit, insert— ‘(1) For the Act, section 22G(1)(a), each of the following paragraphs states a region of the State for which a ballot must be conducted— (a) Central Queensland Coast and Wet Tropics Bioregions, other than land in the CYPLUS area ( region A ); 1 (b) New England Tableland and South East Queensland Bioregions ( region B ); (c) Brigalow Belt Bioregion (North) ( region C ); 2 (d) Brigalow Belt Bioregion (South) ( region D ); (e) Channel Country, Gulf Plains and Northwest Highlands Bioregions, other than land in the CYPLUS area ( region E ); (f) Desert Uplands, Einasleigh Uplands and Mitchell Grass Downs Bioregions, other than land in the CYPLUS area ( region F ); (g) Mulga Lands Bioregion ( region G ). 1 Maps showing the bioregions and the CYPLUS area may be inspected on the department’s website at < 2 A map showing the land included in Brigalow Belt Bioregion (North) and Brigalow Belt Bioregion (South) may be inspected at the department’s head office in Brisbane.
s3 3 s3 Vegetation Management Amendment Regulation No. 179, 2004 (No. 2) 2004 ‘(1A) For the Act, section 22G(1)(b), the ballot for each region mentioned in subsection (1) must be conducted— (a) in Brisbane, commencing at 10 am on 17 September 2004; and (b) by— (i) the chief executive assigning a unique identification number to each application included in the ballot; and (ii) an entity that is not part of the department, appointed by the chief executive, using an electronic random number generating system to decide the priority in which the applications will be assessed. ‘(1B) The chief executive may invite persons representing key stakeholder groups to observe the ballot. Examples of key stakeholder groups — AgForce, Queensland Farmers’ Federation, entities concerned with the protection of the environment ‘(1C) For the Act, section 22G(1)(c), the clearing allocations for the regions are as follows— (a) region A—2 720 hectares; (b) region B—2 720 hectares; (c) region C—27 210 hectares; (d) region D—25 000 hectares; (e) region E—13 610 hectares; (f) region F—56 630 hectares; (g) region G—72 110 hectares. ‘(1D) However, if the clearing allocation mentioned in subsection (4) for a region is not exhausted when all applications for the region have been assessed— (a) the chief executive may allocate the remaining part of the clearing allocation for the region amongst the other regions; and
s4 4 s4 Vegetation Management Amendment Regulation No. 179, 2004 (No. 2) 2004 (b) the part allocated to a region under paragraph (a) together with the allocation mentioned for the region in subsection (4) is the clearing allocation for the region for the Act, section 22G(1)(c).’. (2) Section 5(1A) to (3)— renumber as section 5(2) to (7). 4 Amendment of s 8 (Fee—Act, s 20C) Section 8, ‘$272.85’— omit, insert— ‘$281.30’.
