Vegetation Management Amendment Regulation (No. 1) 2009 [s 1] 1 Short title This regulation may be cited as the Vegetation Management Amendment Regulation (No. 1) 2009 . 2 Commencement This regulation commences on 6 November 2009. 3 Regulation amended This regulation amends the VegetationManagementRegulation 2000 . 4 Amendment of s 1A (Definitions) (1) Section 1A, definition vegetation category area — omit. (2) Section 1A— insert— ‘ field visit means an inspection or assessment of an area by an authorised officer to assist in the development of a restoration plan for the area. key resource area means a key resource area under the Planning Act.’. 5 Amendment of s 2 (Regional ecosystems) (1) Section 2(3), ‘not of concern’— omit, insert — ‘least concern’. (2) Section 2(5), from ‘for’— omit, insert — ‘for section 8(b) of the Act.’. (3) Section 2(6)— 2009 SL No. 245 Page 3
Vegetation Management Amendment Regulation (No. 1) 2009 [s 6] omit, insert — ‘(6) The regional ecosystem number for each regional ecosystem mentioned in schedules 1 to 5, column 1 is shown in column 2 of the schedules opposite the regional ecosystem.’. 6 Amendment of s 3 (Matters prescribed for property vegetation management plan) (1) Section 3(2) and (3)— renumber as section 3(5) and (6). (2) Section 3(1)— omit, insert— ‘(1) This section prescribes matters for the Act, schedule, definition property vegetation management plan . ‘(2) The matters to be included in a property vegetation management plan to which a vegetation clearing application relates are— (a) the location and extent of the area proposed to be cleared under the application; and (b) the relevant purpose under section 22A(2) of the Act to which the application relates; and (c) details of the way the proposed clearing achieves the required outcomes under— (i) the relevant regional vegetation management code; or (ii) if the proposed clearing is within a declared area and a declared area code exists for the area—the declared area code for the area; or (iii) if the proposed clearing is in a wild river high preservation area—the wild rivers code under the Wild Rivers Act 2005 ; or (iv) if the proposed clearing is on indigenous land in the Cape York Peninsula Region—the special clearing code. Vegetation Management Amendment Regulation (No. 1) 2009 [s 6] Editor’s note — The codes are available on the department’s website at < The regional offices where the digital electronic form of the codes can be inspected are stated on the department’s website. ‘(3) The matters to be included in a property vegetation management plan to which a concurrence agency application relates are— (a) the location and extent of the area proposed to be cleared under the application; and (b) the relevant purpose under section 22A(2) of the Act to which the application relates; and (c) details of the location and extent of— (i) infrastructure, including buildings, fences, roads and electrical, telecommunication or sewerage services; and (ii) firebreaks and fire management lines; and (d) details of the way the proposed clearing— (i) complies with the concurrence agency policy applicable to the application; and (ii) achieves the required outcomes under the relevant regional vegetation management code. ‘(4) If an offset is proposed to satisfy a required outcome under a code applying to a vegetation clearing application or concurrence agency application, the following matters are also to be included in the property vegetation management plan to which the application relates— (a) details on how the clearing of vegetation has been avoided or minimised; (b) details on how the proposed offset complies with the offsets policy.’. (3) Section 3— insert— ‘(7) In this section— 2009 SL No. 245 Page 5
Vegetation Management Amendment Regulation (No. 1) 2009 [s 7] Cape York Peninsula Region see section 19N(6) of the Act. relevant regional vegetation management code means the regional vegetation management code for the region of the State in which the area proposed to be cleared under the vegetation clearing application or concurrence agency application is situated.’. 7 Insertion of new ss 3AA–3AC After section 3— insert— ‘3AA Approval of concurrence agency policies—Act, s 10A ‘(1) The document that is version 2 of ‘Concurrence Agency Policy for Material Change of Use (MCU)’, made by the chief executive on 21 October 2009, is approved as a concurrence agency policy. ‘(2) The document that is version 2 of ‘Concurrence Agency Policy for Reconfiguring a Lot (RaL)’, made by the chief executive on 21 October 2009, is approved as a concurrence agency policy. ‘3AB Approval of offsets policy—Act, s 10C ‘The document that is version 2 of ‘Policy for Vegetation Management Offsets’, made by the chief executive on 21 October 2009, is approved as the offsets policy. ‘3AC Approval of regional vegetation management codes—Act, s 14 ‘(1) The document called ‘Regional Vegetation Management Code for Southeast Queensland Bioregion—version 2’ is approved as the regional vegetation management code for the bioregion named in the document. ‘(2) The document called ‘Regional Vegetation Management Code for Coastal Bioregions—version 2’ is approved as the regional vegetation management code for the bioregions named in the document. Vegetation Management Amendment Regulation (No. 1) 2009 [s 8] ‘(3) The document called ‘Regional Vegetation Management Code for Brigalow Belt and New England Tablelands Bioregions—version 2’ is approved as the regional vegetation management code for the bioregions named in the document. ‘(4) The document called ‘Regional Vegetation Management Code for Western Bioregions—version 2’ is approved as the regional vegetation management code for the bioregions named in the document. 8 Replacement of s 3B (Approval of particular vegetation management maps—Act, s 20AG) Section 3B— omit, insert— ‘3B Approval of particular vegetation management maps—Act, s 20AG ‘(1) The map called ‘Regional Ecosystem Map—version 6’, certified by the chief executive on 21 October 2009, is approved as the regional ecosystem map. ‘(2) The map called ‘Remnant Map—version 6’, certified by the chief executive on 21 October 2009, is approved as the remnant map. ‘(3) The map called ‘Regrowth Vegetation Map—version 2’, certified by the chief executive on 21 October 2009, is approved as the regrowth vegetation map. ‘(4) The map called ‘Essential Habitat Map—version 3’, certified by the chief executive on 21 October 2009, is approved as the essential habitat map. 9 Amendment of s 4 (Application for property map of assessable vegetation—Act, s 20C) (1) Section 4, heading, ‘property map of assessable vegetation’— omit, insert— ‘ PMAV ’.
