VARIATION TO LICENCE AREA PLAN FOR MUDGEE RADIO – No 1 of 2008

Pursuant to subsection 26(2) of the Broadcasting Services Act 1992, the Australian Communications and Media Authority varies the Licence Area Plan for Mudgee (Radio) determined on 26 June 1997 (the principal instrument) in the manner set out below:

1)The Determination in the principal instrument is varied to:

a)number each of the paragraphs in the Determination consecutively as clauses (1), (2), (3) and (4);

b)in clause (2),

i)omit the words “two commercial radio broadcasting services” and substitute the words “one commercial radio broadcasting service”;

ii)omit the words “Attachment 1.2 – 1.8 to this Determination” and substitute the words “Attachments 1.2 and 1.5 – 1.8 to this Determination”;

c)in clause (3), omit the words “This community radio broadcasting service with the service licence number SL10102 referred to in Schedule Two is to be available two years after publication of the notice in the Commonwealth of Australia Gazette stating this licence area plan has been made.”;

d)insert the following clause after clause (4):

“(5) One commercial radio broadcasting service is to be available in the area described at Attachment 4.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 4.1 are set out in Schedule Four and Attachments 4.2 – 4.3 to this Determination.”

e)insert the following clause after clause (5):

“(6) A reference in this determination to a schedule or an attachment includes a reference to a schedule or attachment as amended from time to time”.

2)Immediately following the Determination, the principal instrument is varied to:

a)omit the heading “SCHEDULES”;

b)omit the words “Each of the schedules set out:”; and

c)omit all six paragraphs marked with dot points.

3)The schedules to the principal instrument are varied to:

a)omit Schedule One of the principal instrument and substitute Schedule One of this instrument; and

b)insert Schedule Four of this instrument after Schedule Three to the principal instrument.

4)The attachments to the principal instrument are varied to:

a)omit Attachment 1.1 of the principal instrument and substitute with Attachment 1.1 of this instrument;

b)omit Attachments 1.3 and 1.4 of the principal instrument;

c)omit Attachment 2.1of the principal instrument and substitute Attachment 2.1 of this instrument;

d)omit Attachment 3.1 of the principal instrument and substitute Attachment 3.1 of this instrument; and

e)insert Attachments 4.1, 4.2 and 4.3 of this instrument after Attachment 3.2 of the principal instrument.
