Variation to Licence Area Plan – Darwin Radio – No.1 of 2014
1. Enabling legislation
The Australian Communications and Media Authority makes this instrument under subsection 26(2) of the Broadcasting Services Act 1992.
2. Name of Instrument
This instrument is the Variation to Licence Area Plan – Darwin Radio – No. 1 of 2014.
3. Commencement
This instrument commences the day after it is registered.
Note: An instrument is registered when it is recorded on the Federal Register of Legislative Instruments (FRLI) in electronic form: see the Legislative Instruments Act 2003, s4 (definition of register). The FRLI may be accessed at Variation
The Licence Area Plan - Darwin Radio determined by the Australian Broadcasting Authority on 17 October 1995 is varied as follows:
(a)on the first page of the instrument after the heading Licence Area Plan – Darwin Radio:
(i)omit the sub-heading “DETERMINATION”;
(ii)number the five paragraphs of text as clauses (1), (2), (3), (4) and (5);
(iii) repeal the clauses (1) – (5) and substitute the following clauses:
(1) This plan for radio broadcasting services in the Darwin area of the Northern Territory is made under subsection 26(1) of the Broadcasting Services Act 1992.
(2) Thirteen national radio broadcasting services, two commercial radio broadcasting services, one community radio broadcasting service and six open narrowcasting radio services are to be available in the area described at Attachment 2.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 2.1 are set out in Schedule Two and Attachments 2.2 - 2.27 to this plan.
(3) Two community radio broadcasting services are to be available in the area described at Attachment 3.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 3.1 are set out in Schedule Three and Attachments 3.2 - 3.3 to this plan.
(4) One community radio broadcasting service is to be available in the area described at Attachment 4.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 4.1 are set out in Schedule Four and Attachments 4.2 - 4.6 to this plan.
(5) Two community radio broadcasting services are to be available in the area described at Attachment 5.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 5.1 are set out in Schedule Five and Attachments 5.2 - 5.4 to this plan.
(6) A reference in this plan to a schedule or an attachment includes reference to a schedule or attachment as amended from time to time.
(b)immediately before Schedule Two:
(i)omit the heading “SCHEDULES”; and
(ii)omit the words “Each of the Schedules sets out:” and all six paragraphs marked with dot points that follow;
(c)omit all schedules and insert the schedules at Attachment A of this instrument;
(d)omit Attachments 2.1, 3.1, 4.1 and 5.1 and insert Attachments 2.1, 3.1, 4.1 and 5.1 at Attachment B of this instrument;
(e)after Attachment 2.23 insert Attachments 2.24 – 2.27 at Attachment B of this instrument;
(f)in each of the Attachments 2.2 – 2.23, 3.2 - 3.3, 4.2 – 4.6 and 5.2 – 5.4, omit the words “Refer to Technical Planning Guidelines” and substitute the words “Refer to Broadcasting Services (Technical Planning) Guidelines 2007”;
(g)at the end of Attachments 2.4 omit the sub-heading ‘Special Condition A:-’’ and the four paragraphs of text that follows that sub-heading;
(h)for each Attachment listed in column 1 of Table 1 at Attachment C:
(i)if there is a Service Licence Number in the corresponding entry in column 2 – substitute the Service Licence Number;
(ii)if there is a Specification Number in the corresponding entry in column 3 – substitute the Specification Number;
(iii)if there is a Nominal Location in the corresponding entry in column 4 – substitute the Nominal Location;
(iv)if there is an Australian Map Grid Reference in the corresponding entry in column 5 – substitute the Australian Map Grid Reference;
(v)if there is a Maximum Antenna Height in the corresponding entry in column 6 – substitute the Maximum Antenna Height;
(i)insert the following words at the end of Attachments 2.2, 2.4, 2.11, 2.12, 2.13, 2.14, 2.17 and 3.3:
Special Conditions :-
If a transmitter is sited at a location other than the nominal location, the licensee must ensure that the median field strength of the transmission at the Department of Defence Shoal Bay Receiving Station does not exceed the greater of: (a) the level that would be received if the transmitter was operating from the nominal location or (b) a level which has been agreed in writing with the Department of Defence.
If a transmitter is sited at a location other than the nominal location, for the purposes of application of Guideline 36 of the Broadcasting Services (Technical Planning) Guidelines 2007, the maximum ERP specified is deemed to be 30 kW and omnidirectional.
If a transmitter is sited at the nominal location, the minimum level of service requirements detailed in Guideline 38 of the Broadcasting Services (Technical Planning) Guidelines 2007 are waived in the sector 5 degrees True to 15 degrees True.
(j)insert the following words at the end of Attachments 3.2 and 4.2:
Special Conditions :-
If a transmitter is sited at a location other than the nominal location, the licensee must ensure that the median field strength of the transmission at the Department of Defence Shoal Bay Receiving Station does not exceed the greater of: (a) the level that would be received if the transmitter was operating from the nominal location; (b) a level that is proven by established operation not to result in interference; or (c) a level which has been agreed in writing with the Department of Defence.
