1. Name
This is the Variation to Licence Area Plan – Shepparton Radio – 2017 (No.1).
2. Commencement
This instrument commences at the start of the day after it is registered on the Federal Register of Legislation.

This instrument is made under subsection 26(2) of the Broadcasting Services Act 1992.
4. Variation
The Licence Area Plan – Shepparton (Radio) – September 1997 (F2005B00828), is varied as follows:
(a) rename the instrument as the “Licence Area Plan – Shepparton Radio”;
(b) amend the heading on the title page so that it reads “Licence Area Plan – Shepparton Radio” and omit the words from the title page “Decisions and Licence Area Plan” and “September 1997”;
(c) on the first page of the instrument:
(i) amend the heading so that it reads “Licence Area Plan – Shepparton Radio” and omit the word “Determination”;
(ii) number the seven paragraphs as clauses (1), (2), (3), (4), (5), (6) and (7) consecutively; and
(iii) omit clauses (1) – (7) and substitute the following clauses:
“(1) This plan for broadcasting services in the Shepparton area of Victoria is made under subsection 26(1) of the Broadcasting Services Act 1992.
(2) Ten national radio broadcasting services, three commercial radio broadcasting services and four open narrowcasting radio services are to be available in the area described at Attachment 1.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 1.1 are set out in Schedule One and Attachments 1.2 – 1.22 to this plan.
(3) One community radio broadcasting service is to be available in the area described at Attachment 2.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in
the area described at Attachment 2.1 are set out in Schedule Two and Attachments 2.2 – 2.6 to this plan.
(4) One community radio broadcasting service is to be available in the area described at Attachment 3.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 3.1 are set out in Schedule Three and Attachments 3.2 – 3.4 to this plan.
(5) Two community radio broadcasting services are to be available in the area described at Attachment 4.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 4.1 are set out in Schedule Four and Attachments 4.2 – 4.3 to this plan.
(6) One community radio broadcasting service is to be available in the area described at Attachment 5.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 5.1 are set out in Schedule Five and Attachment 5.2 to this plan.
(7) In this plan, unless the contrary intention appears:
(a) a reference to a schedule or an attachment includes reference to that schedule or attachment as amended from time to time;
(b) a reference to any other legislative instrument is a reference to that other instrument as in force from time to time; and
(c) a reference to any other kind of instrument or writing is a reference to that other instrument or writing as in force or in existence at the time the reference was included in this plan.

(d) immediately before Schedule One:
(i) omit the heading “SCHEDULES”;
(ii) omit the words “Each of the Schedules sets out:” and all six paragraphs marked with dot points that follow;
(e) emit all Schedules and substitute all Schedules to this instrument; and
(f) omit all Attachments and substitute all Attachments of this instrument.
