1                 Name

This instrument is the Variation to Licence Area Plan – Remote Western Australia (Radio) – 2017 (No.1).

  1. Commencement

This instrument commences at the start of the day after it is registered on the Federal Register of Legislation.

This instrument is made under subsection 26(2) of the Broadcasting Services Act 1992.

  1. Variation

The Licence Area Plan – Remote Western Australia (Radio) – August 1996 (F2005B01264), is varied as follows:

(a)    rename the instrument as the “Licence Area Plan – Remote Western Australia Radio”;

(b)    amend the heading on the title page so that it reads “Licence Area Plan – Remote Western Australia Radio”;

(c)    on the first page of the instrument,

(i) amend the heading “LICENCE AREA PLAN

REMOTE WESTERN AUSTRALIA” so that it reads “Licence Area Plan – Remote Western Australia Radio”; and

(ii) number the paragraphs after the heading “DETERMINATION” as clauses (1) to (25);

(d)   omit clauses (1) to (25) and substitute the following clauses:

“(1) This plan for broadcasting services in the Remote Western Australia area of Western Australia is made under subsection 26(1) of the Broadcasting Services Act 1992.

(2)        Two national radio broadcasting services, two commercial radio broadcasting services and twenty eight open narrowcasting radio broadcasting services are to be available in the area described at Attachment 1.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 1.1 are set out in Schedule One and Attachments 1.2 – 1.150 to the plan.

(3)        One community radio broadcasting service is to be made available in the One Arm Point (Ardyaloon) area described at Attachment 2.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 2.1 are set out in Schedule Two and Attachment 2.2 to this plan.

(4)        One community radio broadcasting service is to be made available in the Balgo area described at Attachment 3.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 3.1 are set out in Schedule Three and Attachment 3.2 to this plan.

(5)        One community radio broadcasting service is to be made available in the Beagle Bay area described at Attachment 4.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 4.1 are set out in Schedule Four and Attachment 4.2 to this plan.

(6)        One community radio broadcasting service is to be made available in the Billiluna area of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 5.1 are set out in Schedule Five and Attachment 5.2 to this plan.

(7)        One community radio broadcasting service is to be made available in the Broome area described at Attachment 6.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 6.1 are set out in Schedule Six and Attachment 6.2 to this plan.

(8)        One community radio broadcasting service is to be made available in the Christmas Island area described at Attachment 7.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 7.1 are set out in Schedule Seven and Attachments 7.2 and 7.3 to this plan.

(9)        One community radio broadcasting service is to be made available in the Cocos Islands area described at Attachment 8.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 8.1 are set out in Schedule Eight and Attachments 8.2 and 8.3 to this plan.

(10)      One community radio broadcasting service is to be made available in the Derby area described at Attachment 9.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 9.1 are set out in Schedule Nine and Attachment 9.2 to this plan.

(11)      One community radio broadcasting service is to be made available in the Djarindjin area described at Attachment 10.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 10.1 are set out in Schedule Ten and Attachment 10.2 to this plan.

(12)      One community radio broadcasting service is to be made available in the Fitzroy Crossing area described at Attachment 11.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 11.1 are set out in Schedule Eleven and Attachment 11.2 to this plan.

(13)      One community radio broadcasting service is to be made available in the Halls Creek area described at Attachment 12.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 12.1 are set out in Schedule Twelve and Attachment 12.2 to this plan.

(14)      One community radio broadcasting service is to be made available in the Jigalong area described at Attachment 13.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 13.1 are set out in Schedule Thirteen and Attachment 13.2 to this plan.

(15)      One community radio broadcasting service is to be made available in the Kalumburu area described at Attachment 14.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 14.1 are set out in Schedule Fourteen and Attachment 14.2 to this plan.

(16)      One community radio broadcasting service is to be made available in the Kiwirrkurra area described at Attachment 15.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 15.1 are set out in Schedule Fifteen and Attachment 15.2 to this plan.

(17)      One community radio broadcasting service is to be made available in the Kununurra area described at Attachment 16.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 16.1 are set out in Schedule Sixteen and Attachments 16.2 – 16.5 to this plan.

(18)      One community radio broadcasting service is to be made available in the Lagrange area described at Attachment 17.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 17.1 are set out in Schedule Seventeen and Attachment 17.2 to this plan.

(19)      One community radio broadcasting service is to be made available in the Looma area described at Attachment 18.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 18.1 are set out in Schedule Eighteen and Attachment 18.2 to this plan.

(20)      One community radio broadcasting service is to be made available in the Meekatharra area described at Attachment 19.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 19.1 are set out in Schedule Nineteen and Attachment 19.2 to this plan.

(21)      One community radio broadcasting service is to be made available in the Newman area described at Attachment 20.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 20.1 are set out in Schedule Twenty and Attachment 20.2 to this plan.

(22)      One community radio broadcasting service is to be made available in the Oombulgurri area described at Attachment 21.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 21.1 are set out in Schedule Twenty One and Attachment 21.2 to this plan.

(23)      One community radio broadcasting service is to be made available in the Tjukurla area described at Attachment 22.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 22.1 are set out in Schedule Twenty Two and Attachment 22.2 to this plan.

(24)      One community radio broadcasting service is to be made available in the Warmun area described at Attachment 23.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 23.1 are set out in Schedule Twenty Three and Attachment 23.2 to this plan.

(25)      One community radio broadcasting service is to be made available in the Wingellina area described at Attachment 24.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 24.1 are set out in Schedule Twenty Four and Attachment 24.2 to this plan.

(26)      One community radio broadcasting service is to be made available in the Yandeyarra area described at Attachment 25.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 25.1 are set out in Schedule Twenty Five and Attachment 25.2 to this plan.

(27)      One community radio broadcasting service is to be made available in the Yungngora area described at Attachment 26.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 26.1 are set out in Schedule Twenty Six and Attachment 26.2 to this plan.

(28)      In this plan, unless the contrary intention appears:

(a)        a reference to a schedule or an attachment includes a reference to that schedule or attachment as amended from time to time”;

(b)        a reference to any other legislative instrument is a reference to that other instrument as in force from time to time; and

(c)        a reference to any other kind of instrument or writing is a reference to that other instrument or writing as in force or in existence at the time the reference was included in this plan.

Note 1: For references to Commonwealth Acts, see section 10 of the Acts Interpretation Act 1901; and see also subsection 13(1) of the Legislation Act 2003 for the application of the Acts Interpretation Act 1901 to legislative instruments.

(e)    immediately before Schedule One:

(i)omit the heading “SCHEDULE”;

(ii)omit the words “The Schedule sets out:” and all six paragraphs marked with dots points that follow;

(f)    omit all Schedules and substitute all Schedules to this instrument; and

(g)   omit all Attachments and substitute all Attachments of this instrument.
