1  Name

  This is the Variation to Licence Area Plan – Port Lincoln Radio – 2019 (No.1).

2  Commencement

  This instrument commences at the start of the day after it is registered on the Federal Register of Legislation.

Note:    The Federal Register of Legislation may be accessed free of charge at  Authority

This instrument is made under subsection 26(2) of the Broadcasting Services Act 1992.

4  Variation

The Licence Area Plan – Port Lincoln Radio - December 2001 (F2005B00709), is varied as follows:

(a)     rename the instrument as the “Licence Area Plan – Port Lincoln Radio”;

(b)     amend the heading on the title page so that it reads “Licence Area Plan – Port Lincoln Radio”;

(c)     immediately before the first paragraph of the instrument, omit the heading, substitute:

LICENCE AREA PLAN – PORT LINCOLN RADIO

(d)    number the paragraphs of the instrument sequentially as paragraph (1) and paragraph (2);

(e)     omit paragraph (1) and substitute the following:

(1)       This plan for broadcasting services in the Port Lincoln area of South Australia is made under subsection 26(1) of the Broadcasting Services Act 1992.

(f)     in paragraph (2):

(i)     omit each occurrence of “Determination” and substitute “plan”;

(ii)   omit “Attachments 1.2 – 1.10” and substitute “Attachments 1.2 – 1.23”;

(g)     after paragraph (2), insert:

(3)       In this plan, unless the contrary intention, appears:

(a)a reference to a schedule or an attachment is a reference to a schedule or an attachment to this plan;

(b)a reference to the Broadcasting Services (Technical Planning) Guidelines 2017 is a reference to that instrument as in force from time to time;

(c)a reference to any other legislative instrument is a reference to that other instrument as in force from time to time; and

(d)a reference to any other kind of instrument or writing is a reference to that other kind of instrument or writing as in force or in existence at the time the reference was included in this plan.
