The Australian Communications and Media Authority makes the following instrument under subsection 26(2) of the Broadcasting Services Act 1992.

1 Name
This is the Variation to Licence Area Plan – Grafton Radio 2020 (No. 1).
2 Commencement
This instrument commences at the start of the day after the day it is registered on the Federal Register of Legislation.

This instrument is made under subsection 26(2) of the Broadcasting Services Act 1992.
4 Amendments
The Licence Area Plan – Grafton (Radio) – August 1998 (F2005B00612) is varied as follows:
(a) rename the instrument as the “Licence Area Plan – Grafton Radio”;
(b) amend the heading on the title page so that it reads “Licence Area Plan – Grafton Radio”;
(c) immediately before the first paragraph of the instrument, omit the heading, and the word “Determination” substitute:

(d) insert (1), (2), (3) and (4) before each respective clause;
(e) omit clauses (1), (2), (3) and (4), substitute:
(1) This plan for broadcasting services in the Grafton area of New South Wales is made under subsection 26(1) of the Broadcasting Services Act 1992.
(2) One national radio broadcasting service, four commercial radio broadcasting services and one open narrowcasting radio service are to be available in the area described at Attachment 1.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 1.1 are set out in Schedule One and Attachments 1.2 - 1.6 to this plan.
(3) One community radio broadcasting service is to be available in the area described at Attachment 2.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 2.1 are set out in Schedule Two and Attachment 2.2 to this plan.
(4) Two community radio broadcasting services are to be available in the area described at Attachment 3.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 3.1 are set out in Schedule Three and Attachments 3.2 and 3.3 to this plan.
(f) after clause (4), omit “(Determined by the Australian Broadcasting Authority on 27 August 1998)”, insert:
(5) In this plan, unless the contrary intention appears:
(a) a reference to a schedule or an attachment is a reference to a schedule or an attachment to this plan;
(b) a reference to the Broadcasting Services (Technical Planning) Guidelines 2017 is a reference to that instrument as in force from time to time;
(c) a reference to any other legislative instrument is a reference to that other instrument as in force from time to time; and
(d) a reference to any other kind of instrument or writing is a reference to that other kind of instrument or writing as in force or in existence at the time the reference was included in this plan.
Note 1: For references to Commonwealth Acts, see section 10 of the Acts Interpretation Act 1901; and see also subsection 13(1) of the Legislation Act 2003 for the application of the Acts Interpretation Act 1901 to legislative instruments.

(g) omit all the text on the page with the heading “SCHEDULES”;
(h) omit Schedules One, Two and Three; substitute Schedules One, Two and Three at Schedule 1 to this instrument;
(i) omit all of the text that appears below Schedule Three but before Attachment 1.1;
(j) omit Attachments 1.1 to 3.2; substitute Attachments 1.1 to 3.3 at Schedule 2 to this instrument.
