The Australian Communications and Media Authority makes the following instrument under subsection 26(2) of the Broadcasting Services Act 1992.

1 Name
This is the Variation to Licence Area Plan – Emerald Radio 2019 (No. 1).
2 Commencement
This instrument commences at the start of the day after it is registered on the Federal Register of Legislation.

This instrument is made under subsection 26(2) of the Broadcasting Services Act 1992.
4 Variation
The Licence Area Plan – Emerald (Radio) – March 1998 (F2005B00750) is varied as follows:
(a) rename the instrument as the "Licence Area Plan – Emerald Radio";
(b) number each of the paragraphs appearing after the heading “DETERMINATION” consecutively as clauses (1), (2) and (3);
(c) in clause (2):
(i) omit “thirteen”, substitute “16”;
(ii) omit “made”;
(iii) omit each occurrence of “determination” and “Determination”, substitute “plan”;
(iv) omit “Schedule One and Attachments 1.2 - 1.33”, substitute “Schedule One, Attachments 1.2 – 1.34, and Attachments 1.38 -1.43”;
(d) in clause (3):
(i) omit “made”;
(ii) omit “determination” and “Determination”, substitute “plan” in each place;
(e) after clause (3) insert:
(4) One community radio broadcasting service is to be available in the area described at Attachment 3.1 to this plan with the use of the broadcasting services bands. The characteristics, including technical specifications, of the community radio service that is to be available in the area described at Attachment 3.1 are set out in Schedule Three and Attachment 3.2 to this plan.
(5) One community radio broadcasting service is to be available in the area described at Attachment 4.1 to this plan with the use of the broadcasting services bands. The characteristics, including the technical specifications, of the community radio service that is to be available in the area described at Attachment 4.1 are set out in Schedule Four and Attachment 4.2 to this plan.
(6) One community radio broadcasting service is to be available in the area described at Attachment 5.1 to this plan with the use of the broadcasting services bands. The characteristics, including the technical specifications, of the community radio service that is to be available in the area described at Attachment 5.1 are set out in Schedule Five and Attachment 5.2 to this plan.
(7) In this plan, unless the contrary intention appears:
(a) a reference to a schedule or an attachment is a reference to a schedule or an attachment to this plan; and
(b) a reference to the Broadcasting Services (Technical Planning) Guidelines 2017 is a reference to that instrument as in force from time to time; and
(c) a reference to any other legislative instrument is a reference to that other instrument as in force from time to time; and
(d) a reference to any other kind of instrument or writing is a reference to that other kind of instrument or writing as in force or in existence at the time the reference was included in this plan.
