1  Name

This is the Variation to Licence Area Plan – Devonport Radio – December 2001 – 2018 (No.1).

2  Commencement

This instrument commences at the start of the day after it is registered on the Federal Register of Legislation.

This instrument is made under subsection 26(2) of the Broadcasting Services Act 1992.

4  Amendments

The Licence Area Plan – Devonport Radio – December 2001 (F2005B00968) (principal instrument) is varied as follows:

(a)  the principal instrument is renamed as the Licence Area Plan – Devonport Radio;

(b)  on page 2, in the heading to the principal instrument, omit:

(i)  “– DECEMBER 2001”; and

(ii)  “DETERMINATION”;

(c)  on page 2:

(i)  before the first paragraph, insert “(1)”;

(ii)  before the second paragraph, insert “(2)”;

(iii)  omit paragraph (1), substitute:

(1) This plan for radio broadcasting services in the Devonport area of Tasmania is made under subsection 26(1) of the Broadcasting Services Act 1992.

(iv)  in paragraph (2), omit “One national radio broadcasting service”, substitute “Two national radio broadcasting services”;

(v)  in paragraph (2), omit “Attachments 1.2 - 1.5”, substitute “Attachments 1.2–1.5”;

(vi)  in paragraph (2), omit “Determination”, substitute “plan” (each occurrence);

(vii)  after paragraph (2), insert:

(3)In this plan, unless the contrary intention appears:

(a)     a reference to a schedule or an attachment is a reference to a schedule or an attachment to this plan; and

(b)     a reference to the Broadcasting Services (Technical Planning) Guidelines 2017 is a reference to that instrument as in force from time to time; and

(c)     a reference to any other legislative instrument is a reference to that other instrument as in force from time to time; and

(d)     a reference to any other kind of instrument or writing is a reference to that other kind of instrument or writing as in force or in existence at the time the reference was included in this plan.

TS4218001 ceases to be available for SL4218 28 days after the first day on which a service provided under SL4218 is transmitted in accordance with TS12000089 in Attachment 1.3A.

Special Condition :-

The CMF at all elevations must not exceed the specified CMF at 0 degrees elevation for all angles of azimuth.

(j)  after Attachment 1.3, insert Attachments 1.3A and 1.3B at Part 2 of Schedule 2 to this instrument;

(k)  in Attachment 1.4:

The coverage area of this transmission is defined as that area within a radius of 15 kilometres measured from a point with the following AMG66 co-ordinates: Zone: 55; Easting: 442060; Northing: 5442730. This point is the same as the nominal transmitter site.
