Proposed variation on the Commission’s own initiative – working from home – Clerks–Private Sector Award 2020 – further issues conference to be listed – direction vacated.
On 20 March 2025, we issued a statement[1] indicating that Commissioner McKinnon would hold a conference on 21 March 2025 to settle the final form of the employer and employee survey questions that Swinburne University of Technology (Swinburne) will use in its research for this matter. Only one issue remained outstanding following the conference, which the Commission will resolve directly with Swinburne.
The parties who appeared at the 21 March 2025 conference have now also requested a further conference to discuss the substantive issues that will arise in this matter. We will accede to this request. The Commissioner’s chambers will issue a notice of listing for this further conference at a time and date to be advised. On the basis that the parties may be in a position to revise and adjust their respective positions as a result of this conference, we are persuaded that it would be premature to require parties to file their proposed working from home clauses, submissions and evidence at this stage. Accordingly, we have determined to vacate item 1 of the directions issued in our 24 October 2024 statement.[2] The timetable for filing of proposed working from home clauses, submissions and evidence, and material in reply, will be revisited at the further directions and programming hearing before the presiding Member on 6 June 2025. A notice of listing for this hearing is issued with this statement.
