An Act to amend the Variation in Sex Characteristics (Restricted Medical Treatment) Act 2023

The Legislative Assembly for the Australian Capital Territory enacts as follows:

1. Name of Act

   This Act is the Variation in Sex Characteristics (Restricted Medical Treatment) Amendment Act 2024.

2. Commencement

   This Act commences on the day after its notification day.

   NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

3. Legislation amended

   This Act amends the Variation in Sex Characteristics (Restricted Medical Treatment) Act 2023.

4. New part 9

   insert

Part 9Transitional

1. Meaning of commencement day—pt 9

   In this part:

   commencement day means the day section 10 commences.

2. Prescribed people who received prior treatment

   (1)This section applies if, before the commencement day, a prescribed person has received medical treatment in relation to their variation in sex characteristics.

   (2)Section 10 and part 4 do not apply in relation to the undertaking of restricted medical treatment on the prescribed person for 12 months after the commencement day.

   (3)For this section, medical treatment—

   (a)includes a surgical or medical procedure or treatment (including the prescription or administration of a drug); and

   (b)need not be restricted medical treatment.

3. Expiry—pt 9

   This part expires 2 years after the commencement day.

   NoteA transitional provision is repealed on its expiry but continues to have effect after its repeal (see Legislation Act, s 88).
