178 1Queensfunbr ANNO OCTODECIMO ELIZABETHAE SECUNDAE REGINAE No. 28 of 1969 An Act to Amend The Valuers Registration Acts 1965 to 1967 in certain particulars [ASSENTED TO 18TH DECEM13ER, 1969] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled , and by the authority of the same , as follows:- 1. Short title and citation . (I) This Act may be cited as the Valuers Registration Act Amendment Act 1969. (2) The Valuers Registration Act of 1965 as subsequently amended is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Valuers Registration Act 1965-1969.
Valuers Registration Act Amendment Act 1969, No. 28 179 2. Amendment to s. 13 and operation of amendment . (1) Section 13 of the Principal Act is amended by, in paragraph 1, adding to subparagraph (3) the following words:- " and (c) where the applicant carries on business or is employed as a public valuer elsewhere than in Queensland, he is regularly engaged in the valuation of land in Queensland.". (2) Paragraph 1 of section 13 of the Principal Act as amended by this Act shall apply to every person who before the passing of this Act has made or hereafter makes application for registration as a valuer pursuant to that paragraph. 3. Amendment to s. 25 . Section 25 of the Principal Act is amended by- (a) numbering the existing provisions as subsection (1); (b) adding the following subsection:- " (2) A person engaged , whether on his own account or as an employee of the Crown or of any other person, in the profession of architecture , engineering or quantity surveying shall not be taken to contravene any provision of subsection (1) of this section by reason only that- (a) he makes or holds himself out as ready to make a valuation of any land or of any building, structure or improvement affixed to land in the discharge of the duties of his profession aforesaid or, if he is an architect, under the authority of The Building Societies Acts 1886 to 1968 or of an approval given under those Acts or The Co-operative Housing Societies Acts 1958 to 1967; and (b) he is not a registered valuer. 4. New s. 29. The Principal Act is amended by- (a) inserting after section 28 the following section :- "29. Code of professional conduct of valuers. (1) The Board may compile a Code of Professional Conduct of Valuers as a guide to the standard of professional conduct expected of valuers and from time to time may revoke the code and compile a fresh code or vary the code by way of addition, omission or substitution of provisions. (2) The Board may publish the code and any variation or revocation thereof in the Gazette by notification. A copy of the Gazette containing a notification of the code or any variation or revocation thereof shall, upon its production in any proceeding, be evidence of the compilation of the code or, as the case may be, of the making of the variation or revocation and of the matter contained therein."; (b) renumbering sections 29 and 30 as sections 30 and 31 respectively.
180 Valuers Registration Act Amendment Act 1969, No. 28 5. Amendment to schedule . The schedule to the Principal Act is amended by, in the first paragraph of clause 11, adding the words " or, in its discretion, appropriate and apply moneys held by it over and above the amount required to meet liabilities payable from its funds in respect of the Board and of the administration of this Act to such objects and purposes as appear to the Board calculated to advance the principles, standards or practice of land valuation in Queensland ". 6. Decimal currency amendments . The Principal Act is amended as set out in the Schedule to this Act.
