VALUATION OF LAND

AMENDMENT ACT 1996

No. 77 of 1996

AN ACT to amend the Valuation of Land Act 1978.

[Assented to 14 November 1996.]

The Parliament of Western Australia enacts as follows:

Short title

1.   This Act may be cited as the Valuation of Land Amendment

Act 1996.

Commencement

2.   This Act comes into operation on such day as is fixed by

proclamation.

Principal Act

3.   In this Act the Valuation of Land Act 1978* is referred to as

the principal Act.

Section 28 amended

4.   Section 28 (1) (c) of the principal Act is amended by inserting

after ‘‘furnish’’ the following —

‘‘

, upon payment of such fee as may be prescribed,

’’.

Section 38 repealed

5.   Section 38 of the principal Act is repealed.

Section 39A inserted

6.   After section 39 of the principal Act the following section is

inserted —

‘‘

Valuer-General may provide goods and services

39A. (1) The Valuer-General may provide goods and services derived from or related to his functions —

(a)

toanyentity,person,bodyorauthority referred to in section 39 (1) (a) or (b); or

(b)

with the approval of the Minister, to any other person.

The Valuer-General may raise such charges in

respect of the provision of goods and services under

subsection (1) as he considers appropriate.

In this section —

‘‘goods and services’’ does not include copies of, or extracts from, valuation rolls, or o ther mater ia l furn ished under section 28 (1) (c).

’’.

Section 49 amended

7. Section 49 (2) of the principal Act is repealed and the

following subsection is substituted —

‘‘

(2) Without limiting the generality of subsection (1), the regulations may require any agency or instrumentality of the Crown, or a local government or any other public authority to furnish to the Valuer-General details of any land owned by or vested in it and which any other person is entitled to use under an agreement or arrangement with it.

’’.
