420 ANNO VICESIMO SEXTO ELIZABETHAE SECUNDAE REGINAE No. 43 of 1977 An Act to amend the Valuationof Land Act 1944-1977 in certain particulars [ASSENTED TO 3RD OCTOBER, 1977] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Valuation of Land Act Amendment Act 1977 (No. 2). (2) The Valuation of Land Act 1944-1977, being the Valuation ofLand Act1944-1975 as amended by the Valuation of Land Act AmendmentAct1977. is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may he cited as the Valuation of • Land Act 1944-1977.
Valuationof Land ActAmendmentAct (No. 2) 1977, No. 43 421 2. Amendment of s. 11 . Section 11 of the Principal Act is amended by, in subsection (2)- (a) omitting the word " twelve " occurring in paragraph (iii) and substituting the word " six "; (b) inserting after paragraph (v) the following paragraph:- " (va) The Local Authority of an Area may make application to the Minister for the valuation made by the Valuer-General of all lands in that Area to have force and effect on and after the date fixed or taken to be fixed pursuant to paragraph (ii) notwithstanding that the amount of that valuation the subject of undetermined objections or appeals exceeds fifteen per centum of the total amount of the valuation; and the valuation shall have force and effect on and after that date and paragraph (v) shall not apply in the case of that valuation where the Governor in Council, on the recommendation of the Minister, so determines by Order in Council published in the Gazette (he being hereby authorized to so determine). The application shall not receive consideration unless it is made not later than the seventh day of June last preceding the date fixed or taken to be fixed by the Governor in Council pursuant to paragraph (ii) where that day is a working day or, if that day is not a working day, not later than the next working day after that day.". 3. Amendment of s. 13. Section 13 of the Principal Act is amended by, in subsection (2)- (a) omitting paragraph (i) and substituting the following paragraph:- " (i) Unless by reason of- (i) implementation of or alteration in zoning under or amendment of a Town Plan; (ii) the application of an ordinance or a by-law of the Local Authority of the Area in question affecting the use or development of land; (iii) any other action or decision of the Local Authority of the Area in question affecting the use or development of land, the Valuer-General is of opinion that the valuation of such land has altered; or "; (b) inserting after paragraph (j) the following paragraph:- " or (k) Unless, in the case of two or more parcels of adjoining land, those parcels become the subject of a common ownership during any such period, no part thereof being leased or let or all the parcels being leased or let to one person, and the Valuer-General is of opinion that, by reason of the foregoing and having regard to such other factors as he considers relevant, the several parcels of land should be included in one valuation. The inclusion in one valuation of the several parcels of land shall be taken to represent an alteration made in the valuation of those several parcels whether or not such firstmentioned valuation is the same as, or different from, the sum of the valuations of those several parcels.";
422 Valuationof Land ActAmendmentAct (No. 2) 1977, No. 43 (c) inserting after the paragraph commencing with the words " The Valuer-General may at any time " the following paragraph:- " The Valuer-General may include in one valuation the several parcels of land referred to in paragraph (k) of this subsection.". 4. Amendment of s. 19. Section 19 of the Principal Act is amended by- (a) in subsection (3), omitting the word " eight " and substituting the word " three "; (b) in subsection (4), omitting the word " eight " and substituting the word " three ". 5. Amendment of s. 26. Section 26 of the Principal Act is amended by, in subsection (1), omitting the word " eight " and substituting the word " three ".
