Editorial changes
The Legislation Act 2001, part 11.3 authorises the Parliamentary Counsel to make editorial amendments and other changes of a formal nature when preparing a law for republication. Editorial changes do not change the effect of the law, but have effect as if they had been made by an Act commencing on the republication date (see Legislation Act 2001, s 115 and s 117). The changes are made if the Parliamentary Counsel considers they are desirable to bring the law into line, or more closely into line, with current legislative drafting practice.
When preparing the authorised version of this republication amendments were not made under part 11.3 (see endnote 1).
Uncommenced provisions and amendments

The value of a penalty unit for an offence against this republished law at the republication date is—
(a)if the person charged is an individual—$100; or
(b)if the person charged is a corporation—$500.

An Act to validate certain fees, and for other purposes
Name of Act
This Act is the Validation of Fees (Cemeteries) Act 2003.
Notes
A note included in this Act is explanatory and is not part of this Act.

Validation of fees
The instruments mentioned in subsection (2) are taken to be, and always to have been, valid for all purposes as if the instruments had been properly—
(a)made under the Cemeteries Act 1933, section 22A; and
(b)notified under the Legislation Act, section 61; and
(c)presented to the Legislative Assembly under the Legislation Act, section 64 (1).
For subsection (1), the instruments are—
(a)the instrument entitled Revocation and Determination of Fees signed by the chairperson of the Canberra Public Cemeteries Trust and dated 6 June 2001; and
(b)the instrument entitled Revocation and Determination of Fees signed by the chairperson of the Canberra Public Cemeteries Trust and dated 14 May 2002; and
(c)the instrument entitled Revocation and Determination of Fees signed by the chairperson of the Canberra Public Cemeteries Trust and dated 23 May 2002; and
(d)the instrument entitled Revocation and Determination of Fees signed by the chairperson of the Canberra Public Cemeteries Trust and dated 3 June 2003.
The fees set out in schedule 1 are taken—
(a)to have been properly determined by an instrument of determination made by the chairperson of the Canberra Public Cemeteries Trust under the Cemeteries Act 1933, section 22A; and
(b)to have applied to the period beginning on 1 July 2001 and ending on 30 June 2002.
The instrument mentioned in subsection (2) (d) is also taken, for the period beginning on 27 September 2003 and ending on 14 November 2003, to be an instrument that was properly—
(a)made under the Cemeteries and Crematoria Act 2003, section 49; and
(b)notified under the Legislation Act, section 61; and
(c)presented to the Legislative Assembly under the Legislation Act, section 64 (1).
Expiry of Act
This Act expires on the day after its notification day.
NoteIf a law validates something that is or may otherwise be invalid, the validating effect of the law does not end merely because of the repeal of the law (see Legislation Act, s 88 (1) (b)).
