REASONS FOR DECISION TO DISMISS OBJECTION APPLICATION

Background

1. On 10 January 2001, the Government party gave notice under s 29 of the Native Title Act 1993 (Cth) of its intention to grant exploration licence EL/22236 and EL/22207 to Sirocco Resources NL (‘the grantee party’) and included in the notice a statement that it considered that the grant attracted the expedited procedure.

1. On 10 May 2001, Valerie Tambling and Ors on behalf of the Angwinmil and Warai peoples and Robert Brown and Ors on behalf of the Larrakia, Wulna, Kungarakan and Warai peoples (‘the native title parties’) made expedited procedure objection applications to the Tribunal.

1. The Department of Mines and Energy on behalf of the Government party has advised the Tribunal that on 1 October 2001, the exploration licence applications made by Sirocco Resources NL were discontinued.

Decision

1. The expedited procedure objection applications are dismissed pursuant to s 148(a) of the Native Title Act 1993 (as amended).
