GAMING, AND OTHER [ASSENTED TO 14TH DECEMBER, 1933.J BE OFFENCES A ACT A~ : ~ ~ ~ ~ ~ ; . it enacted bv the King's Most Excellent Majesty. by and with the advice and consent of the Legis~ lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title 1. This Act may be cited as " The Vagrants, Gaming, : ~ ~ struction. and Other O.ffences Act Amendment Act of 1933," and shall be read as one with *" The Vagrants, Gaming, and Other Offences Act of 1931," herein referred to as the Principal Act. The Principal Act and this Act may collectively be cited as "The Vagrants, Gaming, and Other Offences Acts, 1931 to 1933." Amendments of the Principal Act. Amendments of the Principal Act. 2. The Principal Act is amended as follows:- Amendment of s. 4. (i.) Section four of the Principal Acts amended as follows:- The following words are added to paragraph (xii.) of subsection one of the said section, namely :-" or without the permission of the Commissioner in a public place or place of public resort solicits, gathers, or collects subscriptions or contributions." * 22 Geo. (a) The following proviso is added to the said section, namely:- "Provided that the Minister shall at any time after the passing of *" The Vagrants, Gaming, and Other Offences Act Amendment Act of 1933" have power and authority, by notice in the Gazette, to dissolve the "Golden Casket" Committee and to vest, subject to the Minister, the conduct and administration of the "Golden Casket" Art Union in the Manager of the "Golden Casket" Art Union; and on such notice the said Committee shall be dissolved and its members shall go out of office accordingly." And section fifty -three as amended shall be renumbered subsection one of section fifty-three accordingly. (b) The following subsections are added to the said section, namely:- " (2.) S e 11 or 0 ff er £ or sa I e or accept any money I . n C A a rt sk U e n t i " on.} respect of the purchase of- (a) Any ticket in any "Golden Casket" Art Union, (b) Any share in any ticket in any "Golden Casket" Art Union; or (ii.) Publish by advertisement in any newspaper, leaflet, handbill, or other printed~ typed, cyclostyled, or written matter, or in any house, building, shop, or on any wall, hoarding, or otherwise such sale of any ticket or any share in any ticket in any " Golden Casket" Art Union; or (iii.) Deliver to any person by whatever mean s any printed, typed, cyclostyled, or written matter advertising or in the nature of advertising such sale of any ticket or any share in any ticket in any "Golden Casket" Art Union, unless such person is the holder of an existing license from the Manager of the" Golden Casket" Art Union authorising him as agent of the" Golden Casket" Art * 24 Geo. Union to so sell or offer for sale or accept money in respect of the purchase of any ticket or share in any ticket in any such" Golden Casket" Art Union: Provided that the above provisions shall not prevent two or more persons from arranging conjointly among themselves for the purchase from any person holding such license of any such ticket or tickets in the name of anyone or more of such persons or under any other name or designation. Advertise· ment. (3.) In any proceedings for a breach of this section- (a) Proof that any person is the holder of an existing license as agent shall lie on the defendant. (b) If in any newspaper, leaflet, handbill, or other printed, typed, cyclostyled, or written matter wherein an advertisement contrary to this section occurs, and in which advertisement the name of the person charged for a breach of an offence against this section appears or is referred to, such person shall be deemed to have advertised or caused such advertisement unless he proves that he had not consented to his name appearing or being referred to in such advertisement, and was wholly ignorant of the advertisement concerned. (4.) Any person who is guilty of an offence against this section shall be liable to a penalty not exceeding one hundred pounds. Nature of (5.) It shall be in the absolute discretion of the license. Manager of the" Golden Casket" Art Union to grant or refuse to any person a license as agent under this section. Any such license so granted is not transferable or assignable by the licensee and shall be revocable at the absolute discretion of the said Manager and, moreover, any decision of the said Manager to refuse to grant or to revoke or cancel any such license shall be final and binding and without appeal to any tribunal whatsoever. Retrospec. Casket" Committee or by the Manager of the "Golden Casket" Art Union, and shall have retrospective .operation accordingly. (6.) The Governor in Council may make regulations Regulations. prescribing the terms, provisions, conditions, and stipulations of any license; the security (including any prescribed fidelity bond) to be given by applicants for such licenses and the recovery and application of the moneys secured; the fees to be paid by licensees for licenses, w'hich security or fees may vary on such basis .or bases as prescribed; and such regulations shall, subject to this section, be and be deemed to be regulations made under section fifty-eight of this Act, and the provisions of section fifty-eight shall, mutatis mutandis, apply and extend accordingly. Such regulations may also provide for the cancellation of any such license on the failure by the licensee to comply with such terms, provisions, conditions, and stipulations, and in addition may prescribe for the imposition of any penalty not exceeding twenty pounds for any breach thereof." This Act may be cited as "The Veterinary Short title. Medicines Act of 1933," and shall come into operation on a date to be proclaimed by the Governor in Council by Proclamation published in the Gazette, which date is herein referred to as the commencement of this Act.
