1074 Vagrants, Gaming, and Other Offences Act Amendment Act 1989, No. 83 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- PART I-PRELIMINARY 1. Short title . This Act may be cited as the Vagrants , Gaming, and Other Offences A ct Amendment Act 1989. PART II-REPEAL OF THE INCLOSED LANDS ACTS 2. Termination of application of The Inclosed Lands Act of 1854. The application in Queensland of the Act of the Parliament of New South Wales known as The Inclosed Lands Act of 1854 is terminated. 3. Repeal of The Inclosed Lands Act of 18 78. The Inclosed Lands Act of 1878 is repealed. PART 111-AMENDMENT OF THE VAGRANTS, GAMING, AND OTHER OFFENCES ACT 1931-1988 4. Citation. (1) In this Part the Vagrants, Gaming, and Other Offences Act 1931-1988 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the Vagrants, Gaining, and Other Offences Act 1931-1989. 5. Amendment of s. 4A. Entering or remaining in or upon buildings, etc., without lawful excuse. Section 4A of the Principal Act is amended by- (a) inserting in the note to the section, after the words "upon buildings," the words "enclosed farms,"; (b) adding at the end of the section the following subsections:- "(3) Any person who, without lawful excuse (the proof of which shall be upon him), enters or remains upon any enclosed land used for the purpose of farming or grazing is guilty of an offence. Penalty: Four penalty units or imprisonment for six months. (4) Any person who, without lawful excuse (the proof of which shall be upon him), opens and leaves open any gate, fence or other barrier that encloses (wholly or in part) any enclosed land used for the purpose of farming or grazing is guilty of an offence. Penalty: Four penalty units or imprisonment for six months.".
