CaseChat Overview and Summary

The Australian Maritime Officers' Union filed an application under section 459(3) of the Fair Work Act 2009 to extend the 30-day period during which industrial action could be authorised by a protected action ballot. The matter before the Fair Work Commission concerned the extension of the 30-day period in relation to a ballot declared on 6 June 2025. The respondent, ASP Ship Management Pty Ltd, did not object to the application.

The primary legal issue for the Commission to resolve was whether the application met the criteria specified in section 459(3) of the Act. This section allows for an extension of the 30-day period if the applicant for the protected action ballot order applies to the FWC for the extension, and if the period has not previously been extended. The Union argued that both conditions were satisfied and that the period should be extended by an additional 30 days.

The Deputy President found that the Union's application fulfilled the requirements of the Act. Since ASP Ship Management Pty Ltd did not oppose the application, and given that the 30-day period had not previously been extended, the Deputy President concluded that the application should be granted. Consequently, the 30-day period for the commencement of protected industrial action for eligible employees was extended by a further 30 days, effective from 10 July 2025.
