UTILITIES COMMISSION REGULATIONS 2001

Regulations under the Utilities Commission Act 2000

1Citation

These Regulations may be cited as the Utilities Commission Regulations 2001.

2Authorisation to make code about ring fencing
  • (1)

    The Utilities Commission is authorised to make a code relating to ring fencing in a regulated industry.

  • (2)

    In subregulation (1):

    ring fencing means the separate operation of related or associated businesses of a licensed entity in a regulated industry.

2AAuthorisation to make code about retail supply in electricity supply industry
  • (1)

    The Utilities Commission is authorised to make a code relating to retail supply in the electricity supply industry.

  • (2)

    Without limiting subregulation (1), the code may deal with one or more of the following:

    • (a)

      transfer of customers between retailers;

    • (b)

      credit support arrangements;

    • (c)

      billing;

    • (d)

      metrology;

    • (e)

      service order arrangements;

    • (f)

      retailer of last resort arrangements;

    • (g)

      dispute resolution.

    2BAuthorisation to make code about standards of service
  • (1)

    The Utilities Commission is authorised to make a code relating to standards of service by licensed entities in the electricity supply industry.

  • (2)

    Without limiting subregulation (1), a code may deal with the following:

    • (a)

      standards of service by licensed entities in the electricity supply industry;

    • (b)

      performance measures for standards of service by licensed entities in the electricity supply industry;

    • (c)

      payments to certain customers if specified standards of service are not met.

    3Authorisation to make rules and determinations
  • (1)

    The Utilities Commission is authorised to make rules relating to the provision of ancillary services in the electricity supply industry.

  • (2)

    The Utilities Commission is authorised to make determinations relating to the prices for providing ancillary services in the electricity supply industry.

  • (3)

    In this regulation:

    ancillary services include:

    • (a)

      reserve capacity;

    • (b)

      frequency support;

    • (c)

      load following services; and

    • (d)

      services necessary for the efficient and reliable operation of a power system.
