765 ANNO VICESIMO SEPTIMO ELIZABETHAE SECUNDAE REGINAE No. 90 of 1978 An Act to amend the Urban Passenger Service ProprietorsAssistanceAct 1975- 1977 in certain particulars [ASSENTED TO 15TH DECEMBER, 1978] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Urban Passenger Service Proprietors Assistance Act Amendment Act 1978. (2) The Urban Passenger Service Proprietors Assistance Act 1975-1977 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Urban Passenger Service Proprietors Assistance Act1975-1978. 2. Amendment of s. 3 . Section 3 of the Principal Act is amended by- (a) in the definition " local pensioner service " omitting the words up to distances not greater than 32 kilometres to or from the principal post office at " and substituting the words " to or from "; (b) in the definition " urban centre " adding at the end thereof the words " or such other area of the State as the Governor in Council by Order in Council declares to be an urban centre ". 3. Amendment of s. 11. Section 11 of the Principal Act is amended by- (a) in subsection (1), (i) inserting after the word " moneys " the words " (and interest thereon) "; (ii) omitting the words "or one or more than one approved passenger omnibus that has been manufactured for less than five years and "• (b) in subsection (2), (i) in paragraph (a),

'66 Urban Passenger Service Proprietors Assistance Act A,ndt Act 1978, No. 90 (A) inserting after the word "Act " the words " with respect to principal moneys "; (B) omitting the words " two-thirds " where they occur in subparagraph (ii) and substituting the words " nine-tenths "; (C) inserting after subparagraph (ii) the following subparagraph:- ([ or (iii) the maximum amount prescribed "; (D) omitting the word " less " and substituting the word " least "; (ii) in paragraph (b), omitting the word " five " and substituting the word " ten ". 4. Amendment of s. 16. Section 16 of the Principal Act is amended by, in paragraph (b), in subparagraph (ii), omitting the words " shall, as and when directed by the Minister," and substituting the words " may, if he thinks it appropriate to do so,". 5. Amendment of s. 17. Section 17 of the Principal Act is amended by- (a) in subsection (1), (i) in paragraph (a), omitting the word " five " where secondly occurring and substituting the word " ten "; (ii) in paragraph (b), in subparagraph (i), omitting the figures 15 " and substituting the figures " 30 "; (b) in subsection (2), in paragraph (c)- (i) omitting the figures " 77 " and substituting the figures " 78 "; (ii) inserting after the figures " 78 " as inserted by this Act the words or such later date as the Governor in Council in a particular case declares ".
