617 ANNA VICESIMO SEXTO ELIZABETHAE SECUNDAE REGINAE No. 5 8 of 1977 An Act to amend the Urban Passenger Service Proprietors As sistance Act 1975,1976 in certain particulars [ASSENTED TO 7TH OCTOBER, 1977] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Urbari Passenger Service Proprietors Assistance Act Amendment Act 1977. (2) The Urban Passenger Service Proprietors Assistance Act 1975-1976 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Urban Passenger Service Proprietors Assistance Act1975-1977.
618 Urban Passenger Service, Etc., Act Amendment Act 1977, No. 58 2. Amendment of s. 3 . Section 3 of the Principal Act is amended by inserting after the definition " Local Authority " the following definition:- local pensioner service " means a passenger omnibus service the subject of a licence or permit under the State TransportAct1960-1972 for the carriage of passengers at separate and distinct fares that provides also for concession fares to pensioners at a prescribed rate based on fares determined by the Commissioner for travel up to distances not greater than 32 kilometres to or from the principal post office at a centre of population (including an urban centre) declared by the Minister to be a local pensioner service; ". 3. Amendment of s. 17. Section 17 of the Principal Act is amended by- (a) in subsection (1), omitting paragraphs (b) and (c) and substituting the following paragraph:- (b)- (i) an amount calculated and payable from time to time equal to 15 per centum of his gross fare revenue for the provision of an urban passenger service of a standard satisfactory to the Commissioner that provides for concession fares to pensioners at a prescribed rate based on fares determined by the Commissioner; and (ii) in cases determined by the Commissioner and approved by the Minister, an additional amount calculated and payable from time to time as prescribed equal to a percentage of his gross fare revenue not exceeding in any case 10 per centum per annum."; (b) in subsection (2), omitting paragraphs (c) and (d) and substituting the following paragraph:- " (c) The subsidy payable pursuant to subsection (1) (b) shall be payable from and including 1st July 1977 on gross fare revenue collected on and from that date."; (c) omitting subsection (3) and substituting the following subsection:- " (3) The Minister is authorised on behalf of the State to pay by way of subsidy to the holder of a licence or permit under the State Transport Act1960-1972 for the carriage of passengers at separate and distinct fares that provides also for a local pensioner service an amount equal to an average of 50 per centum of the adult fare calculated and payable from time to time as prescribed. as compensation for the fare revenue lost by him in providing concession fares to pensioners at a prescribed rate based on fares determined by the Commissioner.".
