Urban Land Corporation (Amendment)

[Assented to 12 June 2001]

The Parliament of Victoria enacts as follows:

1. Purpose

The purpose of this Act is to amend the Urban
Land Corporation Act 1997 to change the title
of that Act and to change the title and functions of

the Urban Land Corporation.

2. Commencement

(1) Subject to sub-section (2), this Act comes into operation on a day to be proclaimed.

(2) If this Act does not come into operation before 1 January 2002, it comes into operation on that day.

4. Definition

In section 3 of the Urban Land Corporation Act

1997—

(a)

in the definition of "board" for "ULC" substitute "URLC";

(b)

for the definition of "ULC" substitute— ' "URLC" means the Urban and Regional

Land Corporation established by this

Act.'.

5. Change of name

In section 4 of the Urban Land Corporation Act

1997—

(a)

in sub-section (1) for "Urban Land Regional Land Corporation";

(b)

for "ULC" (wherever occurring) substitute "URLC".

6. Functions

In section 6 of the Urban Land Corporation Act
1997, for sub-section (1) substitute—
"(1) The functions of URLC are—

(a)

transfer or otherwise acquire land in

to purchase, consolidate, take on development for urban purposes; and

(b) to carry out development of land alone or in partnership or to enter into arrangements or agreements for the development of land; and
(c)

residential and related purposes to

to develop land in Victoria for in Victoria; and

(d) to promote best practice in urban and community design and development, having regard to links to transport
services and innovations in sustainable
development; and
(e) to contribute to improvements in housing affordability in Victoria; and
(f) to provide consultancy services in relation to the development of land whether within or outside Victoria or

outside Australia; and

(g)

to carry out any other functions conferred on URLC by this Act.".

7. Other amendments

(1) In the heading to Part 2 of the Urban Land

Corporation Act 1997 after "URBAN" insert
"AND REGIONAL".

(2) In sections 5, 6(2), 7 and 8 of the Urban Land

Corporation Act 1997 for "ULC" substitute
"URLC".

(3) In sections 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19,

20, 21, 22, 23, 24, 25, 26 and 27 of the Urban

Land Corporation Act 1997 for "ULC"

(wherever occurring) substitute "URLC".

(4) In sections 25 and 26 of the Urban Land

Corporation Act 1997 for "ULC's" (wherever occurring) substitute "URLC's".

(5) In the heading to Part 6 of the Urban Land

Corporation Act 1997 for "ULC" substitute

"URLC".

(6) In sections 28 and 29 of the Urban Land

Corporation Act 1997 for "ULC" substitute

"URLC".

(7) In the heading to Schedule 1 to the Urban Land

Corporation Act 1997 for "ULC" substitute

"URLC".

(8) In clauses 1, 2, 3, 4, 5, 6, 7, 8, 9, 10 and 11 of

Schedule 1 to the Urban Land Corporation Act 1997 for "ULC" (wherever occurring) substitute "URLC".

8. New section 38 inserted

After section 37 of the Urban Land Corporation
Act 1997 insert—

"38. Transitional—Urban Land Corporation

(Amendment) Act 2001

(1) On and from the commencement of this

section, in any Act other than this Act or in section 37 of this Act or in any instrument made under any Act or in any other

document of any kind—

(a)

a reference to the Urban Land Corporation Act 1997 is deemed to be a reference to the Urban and Regional Land Corporation Act 1997; and

(b)

a reference to the Urban Land Corporation or ULC is deemed to be a reference to URLC.

(2) The Urban and Regional Land Corporation is

deemed to be the same body as the Urban Land Corporation despite the change to its name by the Urban Land Corporation

(Amendment) Act 2001 and any act matter or thing is not to be affected because of the change of name.".

9. Amendment to Borrowing and Investment Powers Act 1987

In Item 20AA of Schedule 1 to the Borrowing and Investment Powers Act 1987 for "Urban Land Corporation" substitute "Urban and

Regional Land Corporation".
10. Amendment to Land Tax Act 1958

(1) In section 9(1AA) of the Land Tax Act 1958 for "Urban Land Corporation" substitute "Urban and Regional Land Corporation".

(2) In section 9(2C) of the Land Tax Act 1958—

(a)

for "Urban Land Corporation Act 1997" Corporation Act 1997"; and

(b) for "Urban Land Corporation" substitute "Urban and Regional Land Corporation".

11. Amendment to Treasury Corporation of Victoria Act 1992

(1) In section 36A of the Treasury Corporation of

Victoria Act 1992 in the definition of "public authority", for "Urban Land Corporation" substitute "Urban and Regional Land Corporation".

(2) In Schedule 1 to the Treasury Corporation of Victoria Act 1992—

(a) for "Urban Land Corporation" substitute "Urban and Regional Land Corporation"; and
(b)
