THE CHIEF JUSTICE:  The orders which should be made are these:

1. That the hearing of the appeal be adjourned to a date to be fixed; not to be re-listed except upon the certification of the solicitors for the parties that negotiations for separation of the issues to be heard have been concluded unsuccessfully in that there is to be no separation.

2. I order that the operation of the order appealed against, namely, an order made in the trial division on 10th November 2005, be stayed, pending further order.

3. That costs be reserved.
