I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Upper Hunter Local Environmental Plan 2013 (Amendment No 4).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to the following land known as the Hunter Valley Equine Research

Centre Precinct at Scone:

(a)

Lots 806–812, DP 1061912, Caulfield Place,

(b)

Lot 10, DP 1050834 and Lot 816, DP 1061912, Flemington Drive,

(c)

Lots 813–815, DP 1061912, Moonee Valley Close,

(d)

Lot 72, DP 852547 and Lot 805, DP 1061912, Randwick Way.

4 Amendment of Upper Hunter Local Environmental Plan 2013

Schedule 1 Additional permitted uses

Insert at the end of the Schedule with appropriate clause numbering:

Use of certain land at Caulfield Place, Flemington Drive, Moonee Valley

Close and Randwick Way, Scone in Zone RE2

This clause applies to the following land known as the Hunter Valley

Equine Research Centre Precinct at Scone:

(a)

Lots 806–812, DP 1061912, Caulfield Place,

(b)

Lot 10, DP 1050834 and Lot 816, DP 1061912, Flemington Drive,

(c)

Lots 813–815, DP 1061912, Moonee Valley Close,

(d)

Lot 72, DP 852547 and Lot 805, DP 1061912, Randwick Way.

(2) Development for the purposes of animal boarding or training establishments and veterinary hospitals is permitted with development consent.
