Whereas application dated 23 August 1978 was made to the registrar of primary producers' co-operative associations for the registration of the Upper Burdekin Co-operative Association Limited as a primary producers' co-operative association under the PrimaryProducers' Co-operative Associations Act1923-1978: And whereas, in accordance with section 9 of the said Act, certain documents accompanied the application setting out, amongst other things, the objects of the proposed association: And whereas the registrar as aforesaid, on 22 September 1978, registered the Upper Burdekin Co-operative Association Limited as a primary producers' co-operative association and issued to it a certificate of registration: And whereas doubts have arisen concerning the validity of the objects of the said Association as objects for which a primary producers' co-operative association may be formed pursuant to section 6 of the said Act and, as a consequence thereof, concerning the valid registration of the said Association and acts, matters and things done or purporting to have been done by it as an association registered under the said Act: And whereas it is expedient to make provision to remove any doubts concerning the validity of the several matters as aforesaid. BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title. This Act may be cited as the Upper Burdekin Co-operative Association Limited Validation Act 1979. 2. Meaning of terms . In this Act " the Act " means the Primary Producers' Co-operative AssociationsAct1923-1978; " the Association." means the Upper Burdekin - Co-operative Association Limited. 3. Validation of the Association, etc. In so far as it may be necessary to ensure the validity thereof- (a) the Association is declared and deemed to be and on and from 22 September 1978 to have been a primary producers' co-operative association duly registered pursuant to the provisions of the Act; (b) the objects of the Association for which the Association was formed are declared and deemed to be and at all material times in respect of the application for registration of the Association and its registration as a primary producers' co-operative association and thereafter to have been objects for which a primary producers' co-operative association may be formed, approved by the Governor in Council in accordance with section 6 (1) (xv) of the Act; (c) the said objects are declared and deemed to be and on and from 22 September 1978 to have been the objects of the Association;

456 Upper Burdekin Co-operative Association Ltd Validation Act 1979 (d) all acts, matters and things done or purporting to have been done on and from 22 September 1978 by the Association as a primary producers' co-operative association registered under the Act that, but for any invalidity, defect or irregularity in the registration of the Association or in its objects or in any other respect, would have been acts, matters and things validly done by the Association duly registered under the Act as a primary producers' co-operative association having the objects as aforesaid are hereby validated, approved, ratified and confirmed.
