Gaming No. 2 (Amendment) Act 1998†

[Assented to 19 May 1998]

The Parliament of Victoria enacts as follows:

1. Purpose

The purpose of this Act is to provide further for the issue of trade promotion lottery permits.

2. Commencement

This Act comes into operation on the day on which it receives the Royal Assent.

3. Director may issue trade promotion lottery permits

No. 16/1997

The Gaming No. 2 Act 1997 is amended as as amended
follows— by No.
90/1997.

(a)

in section 28, for "Authority" (wherever occurring) substitute "Director";

(b)

in section 29, for "Authority" (wherever occurring) substitute "Director";

(c)

in section 30, for "Authority" substitute "Director".

4. Transitional

In section 122 of the Gaming No. 2 Act 1997, after sub-section (11) insert—

"(12) If, immediately before the commencement of

section 3 of the Gaming No. 2

(Amendment) Act 1998—

(a)

an application for a permit has been made to the Authority but not determined under section 29; or

(b)

an application to the Administrative Appeals Tribunal for the review of a decision of the Authority under section 29 has been commenced but not determined—

this Act, and regulations made under this commencement of section 3 of that Act continue to apply as if section 3 of that Act had not been enacted.".
