Tattersall Consultations (Amendment)

Act 1999†

The Parliament of Victoria enacts as follows:

1. Purpose

The purpose of this Act is to provide further for lotteries and games without the issue of tickets to subscribers.

2. Commencement

(1) Sections 1 and 3 and this section come into

operation on the day on which this Act receives
the Royal Assent.

(2) The remaining provisions of this Act come into

operation on 1 July 1999.

In this Act, the Tattersall Consultations Act as at 24 November
1958 is called the Principal Act. 1998.

4. Definition

In section 3 of the Principal Act, in the definition of ' "amount subscribed" or "total subscriptions" ', after paragraph (a) insert—

"(ab) an amount determined by multiplying by

10 cents the number of subscriptions in football pool in respect of which a ticket was not issued; or".

5. Subscriptions without the issue of a ticket

(1) In section 5(5) of the Principal Act, after "may"

insert ", by instrument,".

(2) In section 5 of the Principal Act, after sub-section

(5) insert—

"(5A) The Minister may, by instrument, authorise

the operator to accept some or all
subscriptions to a lottery or game by a
method, approved by the Minister, other than

by the issue of a ticket to the subscriber.".

6. New section 6AA inserted

After section 6AAA of the Principal Act insert—

'6AA. Subscription levy where no ticket issued
(1) A levy of 10 cents is payable in respect of

each subscription, accepted otherwise than

by the issue of a ticket, to a Consultation
(other than a Consultation entitled "Tatts 2",

a Super 66 game or an Instant Money
Lottery) or a soccer football pool.

(2) The levy must be paid by the promoter to the Treasurer for payment into the Consolidated Fund and is payable on each Tuesday in

respect of Consultations and soccer football pools conducted during the period of 7 days ending on the preceding Saturday.

(3) If the Treasurer so requires, the promoter

must furnish to the Treasurer at the times and
in the manner specified, any statement,
returns and accounts relating to the
subscription levy that the Treasurer

specifies.

(4) Levy paid under this section is not duty for

the purposes of section 7.'.

7. New section 13 inserted

After section 12 of the Principal Act insert—

"13. Validation

(1) Any—

(a)

subscriptions to a lottery or game accepted by the operator; and

(b)

levy and duty paid in respect of those subscriptions—

before the commencement of sections 5 and
6 of the Tattersall Consultations
(Amendment) Act 1999 are deemed to have
been validly accepted and paid as if that Act
had been in operation at that time.

(2) Subscriptions referred to in sub-section (1) are deemed always to have been part of the amount subscribed.".
