Transport Acts (Further Amendment)

Act 1999†

[Assented to 28 April 1999]

The Parliament of Victoria enacts as follows:

1. Purposes

The purposes of this Act are—

(a)

to amend the Public Transport Competition Act 1995 to—

(i)

period permitted before certain
operators of road transport passenger

extend the length of the transitional accredited; and

(ii)

courtesy services in certain

exempt private bus services and be accredited; and

(iii)  provide for a prescribed fee for the temporary accreditation of a person to operate a road transport passenger service; and

(b)

to amend the Transport Act 1983 to repeal the provisions concerning the licensing of passenger ferry services.

2. Commencement

(1) This Act (except sections 8 and 9) comes into operation on the day on which it receives the Royal Assent.

(2) Subject to sub-section (3), sections 8 and 9 come

into operation on a day to be proclaimed.

(3) If sections 8 and 9 do not come into operation

before 1 July 2000, they come into operation on

that day.

3. Definitions

In section 3(2) of the Public Transport

No. 68/1995. Reprint No. 1

Competition Act 1995 after "1983" (where first as at
occurring) insert '(other than "operate")'. 22 October
1998.

4. Application of Act

At the end of section 3A of the Public Transport
Competition Act 1995 insert—

"(2) Despite anything to the contrary in this Act,

a person who operates a private bus service if every bus operated by that person for the

or a courtesy service is not required under

purposes of that service is hired from a
person who operates a hire and drive service
and who is accredited in accordance with

Part 2 to operate that hire and drive service.".

5. Fee for temporary accreditation

After section 10(1B) of the Public Transport
Competition Act 1995 insert—

"(1C) Without limiting sub-section (1)(b), the regulations may make it a condition of a temporary accreditation that the accredited

person pay, at the prescribed time and in the
prescribed manner, a prescribed temporary

accreditation fee.".

6. Amendment of transitional provisions

In section 39(3) of the Public Transport

Competition Act 1995—

(a) for "on a date that is later than 42 months after that commencement" substitute "on or after 1 May 2000"; and
(b) for "at the end of 42 months after that commencement" substitute "at the beginning of 1 May 2000".

7.  Amendment of transitional provisions (1997 amendments)

" substitute "until 1 May 2000".

In section 40(4) of the Public Transport 12 months after the commencement of section 33 of the Transport Acts (Amendment) Act 1997

9. Consequential amendments

(1) In section 86(1) of the Transport Act 1983, in the
definition of "operate", paragraph (c) is repealed.

(2) In section 86(1) of the Transport Act 1983, in the

definition of "owner"—

(a)

in paragraph (a) for ", tow truck or passenger ferry" substitute "or tow truck";

(b)

in paragraph (b) for ", tow truck or passenger ferry" substitute "or tow truck".

(3) In section 86(1) of the Transport Act 1983, the

definition of "passenger ferry" is repealed.

10. Statute law revision

In section 4(2) of the Transport Act 1983, in
paragraph (c), for "Ministry" substitute

"Department".
