Prevention of Cruelty to Animals
(Amendment) Act 2000†
[Assented to 18 April 2000]
The Parliament of Victoria enacts as follows:
1. Purposes
The purposes of this Act are to amend the
Prevention of Cruelty to Animals Act 1986 to—
(a)
make further provision for the offence in relation to the carrying of dogs, while unrestrained, on certain vehicles on highways; and
(b)
amend the method of making Codes of Practice.

2. Commencement
This Act comes into operation on the day after the day on which it receives the Royal Assent.
3. Principal Act

4. Codes of Practice
(1) In section 3(1) of the Principal Act, in the
definition of "Code of Practice", for "prepared"
substitute "made".
(2) In section 7(1) of the Principal Act, for "The
Minister may with the approval of the Governor in may make".

5. Dogs on moving vehicles
(1) In section 15A(1) of the Principal Act, insert the
following definitions—
' "motor vehicle" has the same meaning as in the
Road Safety Act 1986;
"tray" means a part of a motor vehicle behind the
cabin that is an open compartment and is
principally constructed to carry a load.'.
(2) In section 15A(2) of the Principal Act—
(a)
for paragraph (a) substitute— "(a) a motor vehicle with a tray; or";

(b)
for "on the tray or trailer" substitute "in or on the tray or trailer (as the case requires)";
(c)
for paragraph (c) substitute— "(c) falling off or out of, or from, or moving
off, the tray or trailer (as the case
requires); or";
(d)
in paragraph (d), for "truck" substitute "motor vehicle".
6. New Part 5 inserted
After section 42 of the Principal Act insert—
"PART 5—TRANSITIONALS
43. Prevention of Cruelty to Animals (Amendment) Act 2000
A Code of Practice prepared by the Minister and published under section 7 as in force immediately before the date of commencement of section 4 of the Prevention of Cruelty to Animals (Amendment) Act 2000 is, on that commencement, deemed to be a Code of Practice made by the Governor in Council and published under section 7 as amended by section 4 of that Act and may be varied or revoked accordingly.".
