Renewable Energy Authority Victoria

(Amendment) Act 2000†

[Assented to 18 April 2000]

The Parliament of Victoria enacts as follows:

1. Purpose

The purpose of this Act is to amend the Renewable Energy Authority Victoria Act 1990 to change the name of the Act and to change the name and functions of the Authority.

2. Commencement

This Act comes into operation on 1 July 2000.

3. Substitution of section 1

For section 1 of the Renewable Energy
Authority Victoria Act 1990 substitute—
"1. Purpose

The purpose of this Act is to establish and regulate the Sustainable Energy Authority Victoria.".

4. Change of name of Authority

(1) For section 4(1) of the Renewable Energy Authority Victoria Act 1990 substitute— "(1) There is established a body corporate called

the Sustainable Energy Authority Victoria.".

(2) In the Renewable Energy Authority Victoria

Act 1990—

(a)

in section 3, for the definition of "Authority" ' "Authority" means the Sustainable Energy

Authority Victoria established by

section 4;";

(b) for the heading to Part 2 substitute—

"PART 2—SUSTAINABLE ENERGY

AUTHORITY VICTORIA".

5. Substitution of sections 5 and 6

For sections 5 and 6 of the Renewable Energy
Authority Victoria Act 1990 substitute—
"5. Objectives of the Authority

The objectives of the Authority are to facilitate energy efficiency and the development and use of renewable energy to achieve environmental and economic benefits for the Victorian community and to

contribute to the reduction of greenhouse gas

emissions.

6.	Functions of the Authority The functions of the Authority are—
(a)	to ensure that the objectives of the Authority are met to the maximum extent that is practicable; and
(b)	to provide information and advice on the efficient use of energy, including renewable energy, and the resulting
benefits to all sectors of the Victorian community; and
(c)	renewable energy and energy efficiency and to facilitate the implementation of energy efficiency measures in all sectors of the Victorian economy

to encourage and promote the use of households; and

(d) development of an economically viable

to encourage and promote the industry in Victoria; and

(e)

to monitor and evaluate research and renewable energy; and

(f) to advise the Minister on policies concerning energy efficiency and renewable energy and related

greenhouse gas issues.".

6. Changes to restrictions on powers of the Authority

In section 8(1) of the Renewable Energy

Authority Victoria Act 1990—

(a) for paragraph (a) substitute—

"(a) lend or grant more than $25 000 to a

particular person or body in any period

of 12 months; or";

(b) in paragraph (b)(i), for "$100 000" substitute "$250 000".

7. Substitution of Part 5

For Part 5 of the Renewable Energy Authority

Victoria Act 1990 substitute—

"PART 5—TRANSITIONAL PROVISIONS

23.

Authority same body as former Authority is to be taken to be the same body as the Renewable Energy Authority Victoria was before 1 July 2000, despite any of the changes made to its name, structure, functions and operation by the Renewable Energy Authority Victoria (Amendment) Act 2000 and no matter or thing is to be affected because of those changes.

24.

References to former bodies Authority Victoria in any subordinate instrument, certificate of title, agreement or other document as far as it relates to any period after 1 July 2000 is to be construed as a reference to the Authority, unless the contrary intention appears.

References to former Act name Authority Victoria Act 1990 in any subordinate instrument, certificate of title, agreement or other document as far as it relates to any period after 1 July 2000 is to

be construed as a reference to this Act,

unless the contrary intention appears.

26. The members of the Renewable Energy
Authority Victoria cease to hold office
immediately before the Renewable Energy

Former Authority members go out of office comes into operation.".

8. Statute law revision

In the heading to Part 4 of the Renewable Energy
Authority Victoria Act 1990, omit "AND

REVIEW".

9. Change of name of Act

In the title of the Renewable Energy Authority Victoria Act 1990, for "Renewable" substitute "Sustainable".
