Vocational Education and Training

(Council Membership) Act 2000†

[Assented to 16 May 2000]

The Parliament of Victoria enacts as follows:

1. Purpose

The purpose of this Act is to amend the

Vocational Education and Training Act 1990—

(a)	to provide that members of Parliament are ineligible to hold office as members of TAFE college councils; and
(b)	to remove those members of Parliament who are members of TAFE college councils from the councils.

2. Commencement

This Act comes into operation on the day after the day on which it receives the Royal Assent.

3.  Members of Parliament ineligible for council membership

No. 45/1990.	After section 28(2) of the Vocational Education
Reprint No. 3
as at	and Training Act 1990 insert—
10 September
1998. Further	"(3) A person who is a member of Parliament
amended by
No. 53/1999.	must not be appointed or elected to be a member of a council.

(4) A person holding office as a member of a

council immediately before the Membership) Act 2000 who was on that date a member of Parliament ceases to hold office as a member of the council.".

4. Consequential amendment

Section 29A of the Vocational Education and

Training Act 1990 is repealed.

5. Statute law revision

In the Vocational Education and Training Act

1990—

(a)	in section 86, in the definition of "law", for "trainees in declared vocations" substitute "apprentices";
(b)	in section 88(2)(a), omit "subject to section 89,";

(c) in section 91AB(1)—

(i)  for "employee" (where first occurring) substitute "employer";

(ii)  for "if the student" substitute "as if the student";

(d) in section 91D(1)—

(i)

in paragraph (a)(i) for "a trainee" apprentice";

(ii)  in paragraph (b)(i) for "trainee" substitute "apprentice".

Education and Training Act 1990 to provide that members of

TAFE college councils from the councils and for other purposes."
