The Parliament of Victoria enacts as follows:

1. Purpose

The purpose of this Act is to amend the (Control of Use) Act 1992 to provide for the labelling of meal derived from material of animal origin.

2. Commencement

(1) Subject to sub-section (2), the provisions of this

Act come into operation on a day or days to be proclaimed.

(2) If a provision referred to in sub-section (1) does not come into operation before 30 May 2001, it comes into operation on that day.

3. Definitions

No. 46/1992. In section 4(1) of the Agricultural and
Reprint No. 2
as at 8 May Veterinary Chemicals (Control of Use) Act
1997. Further 1992—
amended by
Nos 58/1997,
46/1998 and (a) in the definitions of "advice note", "label"
52/1998. and "package", for "or stock food" (wherever
occurring) substitute ", stock food or meal
of animal origin";
(b)

after the definition of "maximum residue ' "meal of animal origin" includes a

mixture of meals of animal origin;'.

4. New section 20 inserted

After section 19 of the Agricultural and
Veterinary Chemicals (Control of Use) Act
1992 insert—

"20. Labelling of certain meal of animal origin

(1) A person who manufactures meal of animal

origin must not sell the meal to another
person unless the meal is accompanied by a
label or advice note that complies with the

regulations.

Penalty:  In the case of a corporation,
400 penalty units.
In any other case, 200 penalty
units.

(2) If a change is made to the requirements for a

label or advice note, the chief administrator
may direct, by notice to a person who
manufactures meal of animal origin, that the
meal must not be sold after the date specified
in the notice without a label or advice note

that accords with the new requirements.

(3) A person who receives a notice under sub-

section (2) must comply with it.

Penalty:  In the case of a corporation,
100 penalty units.
In any other case, 50 penalty units.

(4) Nothing in this section applies to a

prescribed meal of animal origin.".

5. Regulations

In section 27(i) of the Agricultural and 1992, in sub-paragraphs (iii) and (iv), for "or stock foods" substitute ", stock foods or meal of animal origin".

6. Statute law revision

In the Agricultural and Veterinary Chemicals

(Control of Use) Act 1992—

(a)

in the penalty at the foot of section 19(6), for "In the case of corporation" substitute "In the case of a corporation";

(b) Part 10 is repealed.
