Tertiary Education (Amendment) Act

2000†

The Parliament of Victoria enacts as follows:

1. Purpose

The main purpose of this Act is to amend the

Tertiary Education Act 1993—

(a)

to repeal certain provisions relating to voluntary student unionism; and

(b)

to make further provision about non- academic fees, subscriptions and charges.

2. Commencement

This Act comes into operation on the day after the day on which it receives the Royal Assent.

3.  Repeal of certain voluntary student unionism provisions

(b) section 12C is repealed;

(c) in section 12F(1), omit "the institution or";

(d)

in section 12F, sub-sections (3), (4) and (5) are repealed;

(e) section 22(3) is repealed.

4. New section 12D substituted

For section 12D of the Tertiary Education Act

1993 substitute—

"12D. Provision for declining automatic

membership of a student organisation

(1) The governing body of a post-secondary

education institution that has procedures to provide for students to become members of an organisation of students as a consequence
of, or at the same time as, enrolling in a
course of study at the institution must ensure
that those procedures provide for a student to
indicate at the time of enrolment that he or
she does not wish to become a member of
the organisation of students.

(2) The governing body of a post-secondary

education institution must ensure that a
student who has indicated, in accordance
with procedures referred to in sub-section
(1), that he or she does not wish to become a
member of an organisation of students is not
made a member of an organisation of
students as a consequence of, or by enrolling
in a course of study at that institution.".

5.  Information about compulsory fees to be included in annual report

(1) For section 12I(1) of the Tertiary Education Act

1993 substitute—

"(1) The governing body of a post-secondary

education institution must ensure that the
institution's annual report under the
Financial Management Act 1994 that is
submitted to the Minister includes a
statement about compulsory non-academic
fees, subscriptions and charges payable in

the preceding financial year.".

(2) Section 12I(3) of the Tertiary Education Act

1993 is repealed.

6. New section 12J substituted

For section 12J of the Tertiary Education Act

1993 substitute—

"12J. Transitional about the use of certain money

Money referred to in section 12F(1), as in force before the amendment of section 12F by the Tertiary Education (Amendment) Act 2000, that was paid to the institution or was a profit made by the institution or an organisation of students in accordance with section 12F before its amendment may be used without having regard to the

requirements of section 12F as in force

before its amendment.".

7. Statute law revision

In section 15(2) of the Tertiary Education Act

1993 for "college" substitute "institution".
