Livestock Disease Control Amendment Act 2007

The Parliament of Victoria enacts:

1Purposes

The purposes of this Act are to amend the Livestock Disease Control Act 1994

(a)to improve the administration and enforcement of that Act; and

(b)to make changes to the cattle compensation scheme.

2Commencement

(1)This Act (other than sections 6, 7 and 8) comes into operation on the day after the day on which it receives the Royal Assent.

(2)Sections 6, 7 and 8 come into operation on a day to be proclaimed.

3Definition of fittings

In section 3(1) of the Livestock Disease Control Act 1994, in the definition of "fittings"—

(a)in paragraph (c), for "livestock;" substitute "livestock; or";

(b)after paragraph (c) insert

"(d)equipment or other articles—

(i)which are normally used in connection with livestock and which have been brought into contact with any livestock product; or

(ii)which are used in the processing or manufacture of livestock products and which have been brought into contact with any livestock product;".

4Destruction or disposal of diseased livestock

(1)For section 15(1)(b) of the Livestock Disease Control Act 1994 substitute

"(b)any livestock, livestock product, fodder, fitting or any other article has been in contact with diseased livestock    or a diseased livestock product—".

(2)In sections 15(1)(c), 15(1)(d) and 15(2) of the Livestock Disease Control Act 1994, for "or livestock product" (wherever occurring) substitute ", livestock product, fodder, fitting or article".

(3)For section 15(3) of the Livestock Disease Control Act 1994 substitute

"(3)If an inspector knows or reasonably suspects that livestock or a livestock product is infected with a disease or that any livestock, livestock product, fodder, fitting or any other article has been in contact with diseased livestock or a diseased livestock product and the owner of the livestock, livestock product, fodder, fitting or article cannot be located after reasonable inquiry and there is no person apparently in charge of the livestock, livestock product, fodder, fitting or article, the inspector may, with the approval of the Secretary, destroy or otherwise dispose of the livestock, livestock product, fodder, fitting or article.".

5Swill feeding of pigs

For section 41(2)(d) of the Livestock Disease Control Act 1994 substitute

"(d)milk;

(e)a milk product or milk by-product from a dairy manufacturing business licensed under the Dairy Act 2000.".

6Cattle compensation fund

After section 71(2)(c) of the Livestock Disease Control Act 1994 insert

"(ca)any money paid to Victoria under any agreement or arrangement to which Victoria is a party for or in respect of compensation for cattle suffering from disease;".

7Payments out of Fund

In section 72(1) of the Livestock Disease Control Act 1994

(a)in paragraph (b), for "being destroyed." substitute "being destroyed;";

(b)after paragraph (b) insert

"(c)to the payment of any amount payable by Victoria under any agreement or arrangement referred to in section 71(2)(ca).".

8Repeal of section 77

Section 77 of the Livestock Disease Control Act 1994 is repealed.

9Disinfection notice

(1)After section 113(1)(b) of the Livestock Disease Control Act 1994 insert

"(ba)livestock or livestock products are kept or commonly kept;".

(2)In section 113(1)(e) of the Livestock Disease Control Act 1994, for "or fitting" substitute


", fitting or any other article".

10Repeal of this Act

This Act is repealed on the first anniversary of the first day on which all of its provisions are in operation.
