Multicultural Victoria Amendment Act 2008

The Parliament of Victoria enacts:
1Purpose
The purpose of this Act is to amend the Multicultural Victoria Act 2004 to—
(a)enhance the functions of the Victorian Multicultural Commission;
(b)provide for the appointment of a Director and other staff of the Victorian Multicultural Commission;
(c)amend the reporting requirements of Government Departments in the area of multicultural affairs;
(d)make other minor amendments.
2Commencement
This Act comes into operation on the day after the day on which it receives the Royal Assent.
3Principal Act
In this Act, the Multicultural Victoria Act 2004 is called the Principal Act.
4Principles of multiculturalism
In section 4(3)(e) of the Principal Act, for "all Victorians" substitute "all individuals in Victoria".
5Functions of the Commission
(1)In section 8(e) of the Principal Act, for "society." substitute "society; and".
(2)After section 8(e) of the Principal Act insert—
"(f)to facilitate community input with respect to meeting the objectives of the Commission; and
(g)to provide information and advice in the area of multicultural affairs to Government Departments and other relevant bodies as necessary.".
6New section 13A inserted
After section 13 of the Principal Act insert—
"13A Director and staff of the Commission
For the purposes of this Act, there are to be employed under Part 3 of the Public Administration Act 2004—
(a)a Director of the Commission; and
(b)as many staff as are required to assist the Commission.".
7Deputy Chairperson of the Commission
For section 14(1) of the Principal Act substitute—
"(1)The Governor in Council, on the recommendation of the Minister, must appoint—
(a)one of the members of the Commission; or
(b)the Director of the Commission—
to be the Deputy Chairperson of the Commission.".
8Reporting requirements of Government Departments
(1)In section 19(a) of the Principal Act, for "language" substitute "interpreting and translating".
(2)In section 19(b) of the Principal Act, after "English" insert "and communications in the ethnic media".
(3)In section 19(c) of the Principal Act, for "communities;" substitute "communities, including the identified needs of youth, older persons and women within these communities;".
(4)In section 19(d) of the Principal Act, for "responsible." substitute "responsible; and".
(5)After section 19(d) of the Principal Act insert—
"(e)the Department's progress under its cultural diversity plan to address provision for culturally sensitive service delivery to Victoria's communities; and
(f)any initiatives developed by the Department that meet the identified needs of culturally and linguistically diverse communities in regional and rural areas of Victoria; and
(g)any measures taken by the Department to promote human rights in accordance with the Charter of Human Rights and Responsibilities for multicultural communities.".
9Repeal of amending Act
This Act is repealed on the first anniversary of its commencement.
Note
The repeal of this Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984).
