Melbourne University Amendment Act 2009
No. 11 of 2009

The Parliament of Victoria enacts:
1Purpose
The main purpose of this Act is to facilitate the amalgamation between the Faculty of the Victorian College of the Arts and the Faculty of Music at The University of Melbourne.
2Commencement
This Act comes into operation on 6 April 2009.
3Establishment of the Faculty of the Victorian College of the Arts
(1)For the heading to section 29A of the Melbourne University Act 1958 substitute―
"Faculty of the VCA and Music".
(2)After section 29A(1) of the Melbourne University Act 1958 insert―
'(1A)Despite subsection (1), the faculty established under that subsection is renamed and known as―
(a)on and from 6 April 2009, the "Faculty of the VCA and Music"; or
(b)if any name is subsequently conferred or imposed on the faculty by the statutes or regulations of the University, that subsequent name.
(1B)On and from 6 April 2009, unless the contrary intention appears, a reference in any Act (other than this Act), subordinate instrument or other document to the Faculty of the Victorian College of the Arts is to be construed as a reference to the Faculty of the VCA and Music.
(1C)If the faculty is subsequently renamed in accordance with subsection (1A)(b), on and from the relevant change, unless the contrary intention appears, a reference in any Act (other than this Act), subordinate instrument or other document to―
(a)the Faculty of the VCA and Music; or
(b)any name subsequently conferred or imposed on that faculty by the statutes or regulations of the University―
is to be construed as a reference to the name of the faculty most recently conferred or imposed on that faculty by the statutes or regulations of the University.'.
(3)In section 29A(2) of the Melbourne University Act 1958, after "statutes" (where twice occurring) insert "or regulations".
(4)Section 29A(3) of the Melbourne University Act 1958 is repealed.
(5)In section 29A(5) of the Melbourne University Act 1958―
(a)in paragraph (a), after "other arts," insert "including music,";
(b)in paragraph (c), after "arts" insert
", including music";
(c)in paragraph (d), for "College" substitute "faculty";
(d)in paragraph (e) for "people." substitute "people;";
(e)after paragraph (e) insert—
"(f)to undertake any other activities determined from time to time by resolution of the Council with the agreement of the faculty.".
4Repeal of amending Act
This Act is repealed on 6 April 2010.
Note
The repeal of this Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984).
